Docket No. 18100003 V UDO Section 3.91.A Min.30' wide greenbelt required along US 421, 19' width proposed. 3. Docket No. 18100004 V UDO Section 3.95.F Drive-Thru location at rear of tract required,North side of building proposed. The site is located at 9701-9703 N. Michigan Rd., on North Augusta Subdivision Lots 8 &9. The site is zoned B2/Business and US 421 Michigan Rd. Corridor. Filed by Rick Lawrence of Nelson& Frankenberger on behalf of ICT, LLC. Petitioner: Rick Lawrence: • With me are Blake Epperson, Alec Kent, Eric Glessner-engineer, and Matt Pleasant of Nelson& Frankenberger • Two lots are incorporated into this project • We applied for an ADLS • The drive-thru wraps around on the east and north side of the building. • The drive-thru is pretty consistent with others in this area along US 421 • The view of the drive-thru will be blocked by the Freddy's building driving northward and by the Holiday Inn while driving southward I • Landscaping will be planted along the drive thru access,as noted in Tab 5 in the info packet • Passed out exhibit of the greenbelt proposal • The ROW takes up more space than the rest of this area on US 421. This created a setback issue of the greenbelt width. The intent is to keep it as grass and not pavement. 1 BZA Hearing Officer Minutes 11-26-18 Public Comments: None Department Report: Angie Conn: • Their variance requests are pretty straightforward • The petitioner needs to clarify the total number of plantings. • We recommend positive consideration of both variances Eric Glessner: We intent to plant the required number of plantings. We are just asking for the amount of area we are required to do the plantings. We have been working the Urban Forester prior to our filing. We believe he is in support of our landscape plan. Board Comments: Brad Grabow: On the north end of the property,what is the Japanese zelkova? Eric Glessner: It's a tree. It has a vase shape to it. It's worked really well in some other properties we have done along this corridor. Brad: Would there be shrubs mixed in with those trees at a lower height? Eric: We will have a couple in there,but we don't have much room. We are placing additional landscaping such as evergreen trees. We are proposing four additional spruces along the property line to provide screening. Brad: I see now it's a mixture of zelkovas and Norway spruces. Brad: If the drive-thru use is granted,and with the S-1 zone adjacent to the east,how would you avoid the drive-thru speaker being aimed horizontally towards the residential area to the east? Can the speakers be mounted overhead or angled downward? Blake Epperson: We can work with the speaker supplier on this and typically they are on the curb. Maybe the speaker can be put at an angle? Brad: Through the ADLS process,this will be questioned because of this drive-thru/commercial use being immediately adjacent to an S-1 district. Brad Grabow: The current plan shows 20 more spaces than required per the UDO. What does the Freddy's franchise suggest is the proper parking ratio? Blake Epperson: 50 to 55 parking spaces. We are more of a sit down,casual restaurant,rather than a truly fast food in-and-out approach. Our guests will spend a little more time and the extra parking will accommodate that. Brad Grabow: What's percentage of sales for drive-thru vs.sit down? Blake Epperson: Drive-thru is 40%of sales. Brad: If you can lose some of the parking,you can add some additional landscaping,buffering,or a wall to buffer the sound of the drive-thru speakers. Blake: The extra parking spots will help.
