FINDINGS OF FACT for USE VARIANCE

Petitioner Old Town Companies L.L.C.
1. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s)
such that enforcement of the Unified Development Ordinance will result in unnecessary hardship because:
the proposed use would allow the site to be utilized as an auto repair facility,which has been the site's previous use.The existing building and a new upgraded facility will be constructed
to improve the site.
2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
the use cf the site shall be a continuation of similar uses already established at the site The site is surrounded on the north,west,and south by B-3 zoning classification which allows automobile repair as a permitted use
3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse
manner because:
the site is surrounded on the north,west,and south by 8-3 zoning classification which allows automobile repair as a permitted use.The site well be used as its previous use.auto repair facility.
A new and upgraded facility will be constructed to improve the site.
4. The need for the variance arises from a natural condition peculiar to the subject property because:
the current zoning classification does not allow automobile repair,however the site has been utilized as an auto repair facility and sales as its previous use.
5. The granting of this variance does not substantially interfere with the Carmel Comprehensive Plan because:
it would allow development of the site in a manner that it has been previously utilized while improving and upgrading the site.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Use Variance Docket No.
18110007 UV is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by ere V
