I believe that the 15' D.E. on the south side of current.Lot 3 will be removed by the replat of Lot 3 only along the lot line between Lots 3 (Estes) and new Lot 4 (Lake City Bank). 2. Lot 3 will be reconfigured to reflect the residual part of Lot 3 that remains after the creation of Lot 4. 3. The south property line for Lot 3 will remain between Lot 3 and the unplatted parcel (not included in the subdivision) owned by Estes along 96th Street west of the LCB parcel (Lot 4). 4. There will be cross easements for access and drainage between Lots 3 and 4 but they will not be included on the plat as they are not for the benefit of the other Lots in the subdivision. 5. Why do the zoning classifications need to be on the Plat? If the classifications change,the Plat is incorrect. 6. Drainage and utility easements can be on the west side of Lot 3 and on the south side except along the lot line with Lot 4. Please let me know your thoughts so that Todd and I can finalize the plat this week. Thanks. I have prepared amended and restated covenants that will be reviewed and approved by all of the property owners. Please note that all owners of the property subject to the plat will be signing the replat. 2. Lot 3 will be the Lake City Bank lot.The residual portion of the former Lot 3 will be in Block A. 3. Lot 3 is not being vacated, it is being replatted. 4. There will be a separate cross easement agreement for ingress and egress between Bill Estes Realty and the Bank.This will not be a platted easement as it will only be for the benefit of the two parcels,the new Lot 3 (Lake City Bank) and Block A(Bill Estes Realty).Additionally,the easement may need to be adjusted to accommodate the development of Block A. This is consistent with the current plat that has only one common ingress/egress easement for the Park.That is the 40'easement stub providing ingress and egress from and to southbound Michigan Road.That is the only easement that is subject to maintenance obligations of all owners. 5. I need to check with Todd but the drainage and utility easements may or may not be included in the plat for two reasons: (a) if they are just for the Estes and Bank parcels and not the rest of the Park, I would not want them on the Plat; and (b) depending on the development of Block A,the easements may need to be amended, it being much easier to amend an easement agreement than the plat. I hope to speak with Todd today. I will be in New York tomorrow and Friday and will not be able to address this matter until next week.
