Below are bullet points of the items we discussed and how we agreed to resolve them: • Gooseneck paint color-We agreed to change the gooseneck color from red to black. • White awning stripes-Awning stripes to remain and Awning material to remain vinyl. • North facade lighting-We agreed that I would reduce the amount of lighting under the north awnings by half. • Stone material - I emailed you a picture of the Lenexa Kansas Freddy's building and you agreed that we could replace the wainscot Indiana limestone with this buff limestone.As for the tower sections of the facade above the wainscot we agreed to use the same material with a more rough hewn or chiseled face. • Fake windows vs Brick panels-You supported the brick panels at the PC meeting and will continue to support the brick panels at sub-committee. We can do that, but then we would be deficient on the southern perimeter requiring 5' of landscape area in addition to the gas easement. As property shifts by+/-20' at the midpoint, this will reduce to 19'for a portion on the southern half of the property. Our hard surface is still setback about 20'farther than the hotel parking lot to the north and there will not be any parking spaces adjacent to the Michigan Road right-of- way. Given the information above and the hardship of the property shifting at the right-of-way,we are hoping this is a variance staff could support. As we discussed over the phone last week,our current plan would be to file an engineered site plan, landscape plan and building elevations on October 12th for the BZA filing deadline. This would be for the drive through variances as well as the greenbelt variance. Then we would be filing the full ADLS/DP filing for the November Plan Commission filing deadline. Our department does not have an issue with the detention facility being installed within the greenspace. However,you will need to contact the City's Urban Forester, Daren Mindham, to ensure that all requirements he has for greenspace are met as well. I have copied him on this email. • If additional greenspace is required for retention can we vacate the proposed parking along the south property line?The parking on the south side can be removed to make room for detention as long as the minimum amount of parking spaces required are provided. I know from past projects and experience that the LED strip lighting will not be allowed and the large blank wall will require some more detailing.That being said, my area of responsibility is signage, so I will deal with that. I've added examples of what spandrel panels would be for this building. Each colored box is a separate spandrel—you would have to choose one of them to use. Once you have the dimensions of the spandrel,the sign height cannot exceed 70%of the spandrel's height and the sign width cannot exceed 85%of the spandrel width.You have two street frontages and would be allowed one sign per street frontage— therefore a maximum of two signs.The sign on each frontage could be a wall or a ground sign, not both. But,yes,the 'frontage road' requirement and vehicular connectivity to adjacent parcels will come into play,too, as you go through the Plan Commission's review/approval process for a retail restaurant. INDOT has jurisdiction over Michigan Road/ US 421 and its access points,and I would say that that curb cut can probably stay for now, but Unified Development Ordinance (UDO)Section 3.98.A will definitely come into play when the Plan Commission reviews your petition. It states the following: "Access to Individual Tracts: The purpose of this subsection is to make the closing of all curb cuts along US 421 -Michigan Road possible by establishing a common access road to the rear parking lots of all tracts within the Overlay District. Frontage roads and common entrances shared by several businesses and developments shall be encouraged and may be required at the discretion of the Plan Commission. In those cases where tracts can be accessed via connection to an arterial, collector, or adjoining parking lot,curb cuts shall not be established on US 421 -Michigan Road. The Plan Commission shall encourage maximum distances between curb cuts to US 421 -Michigan Road in cooperation with the Indiana Department of Transportation (INDOT). Bicycle and pedestrian circulation to and through the site shall be coordinated with vehicular access, Greenbelt design, and parking." If you have not done so already, please schedule a pre-filing meeting with Rachel Keesling in our office; as she is the Planner who will help guide you and your commercial project through the Plan Commission process.
