Docket No.1901 0014V Ly Hearing date—Feb 25, 2019 at 5:30 pm Introduction-We are requesting a variance to be able to utilize a little more of Mr. Peasley's yard in order to accommodate an in ground pool and pool deck. What We Are Asking For. Carmel currently requires that any part of a pool including the deck must be 3' from an easement ("3' buffer") and 10' from a side property line. We are requesting that we be able to utilize the 3' buffer for the pool deck and be granted consent to build part of the pool deck 5' from a side property line, all as shown in the site plan attached to our variance application. Statement of Support. It should be noted that the Peasley's neighbor to the west that would be affected by the 5' encroachment has provided a written consent and statement of support of this project. As to drainage, the rear drainage easement will be unchanged and the Peasley's plan is that drainage flows will remain unimpeded. The Peasley's also intend to maintain the swell to the west of the project and not to push water onto their neighbor's property. The homeowner has employed solid professionals for this project. Perma Pools is the pool contractor and has a long history in Carmel. The remainder of the project (decking,fireplace, outdoor kitchen and overhead structures) is being constructed by Case Design, a contractor that is located in Carmel and who also has a long and successful history in Carmel. All construction will be per code and to all special requirements of Carmel. An automatic safey cover per code will be installed to minimize the risks of a pool. Trust("Owner"). To facilitate such construction, Applicant has requested a variance from Carmel Unified Development Ordinance Section 5.02.C.7. to permit an encroachment of 5' into the 10' required side setback on the west of the property and to encroach up to the 15' easement line on the south of the property (current setback is easement width plus 3' required) to permit the building of the subject improvements. The Owner's property is known as 935 Doe Run Drive, Carmel, Indiana 46032 (Tax ID# 17-09-22-03-03-042.000).
