1. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s)
such that enforcement of the Unified Development Ordinance will result in unnecessary hardship because:

2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The prepared use is consistent with surrounding uses and has no impact on
public health or safety, morals or general welfare.
3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse
manner because:
The proposed use is the same as the adjacent use to the east. The other 3
corners of 106th Street and College are similar.
4. The need for the variance arises from a natural condition peculiar to the subject property because:
Its size and location prohibit development under the Overlay zone restrictions.
5. The granting of this variance does not substantially interfere with the Carmel Comprehensive Plan because:
The comprehensive plan contemplates this location as commercial/community
vitality use.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Use Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.

Statement of Variance Request (short paragraph explaining what you are asking for)
The property is zoned B-2 that permits automobile sales and service. The Home Place Overlay
(HP-OL) District § 3.01 prohibits auto sales and service. The Applicant seeks to use this vacant
lot for automobiles sales.
Statement of Support (short paragraph explaining reasons supporting the request)
The property historically has been an auto service/repair facility. The original service station
building has been demolished and the applicant who owns the automobile sales/service business
immediately east of the site, desires to expand his existing business onto the property.
