Statement of Variance Request Allow the motor home to be parked closer to the lot line than currently allowed by Zoning Code. Statement of Support The Wesleys have been parking an RV in the driveway close to the property line well before the City of Cannel ordinance became effective. The motor home is 12 feet tall and is allowed to be parked 36 feet from the property line. The Wesley are asking for permission to park the RV 15 feet from the property line. They have always parked it there and built a reinforced driveway extension closer to the property line before the Ordinance was in effect. This is an old neighborhood, the house directly to the west is assessed at$148,000.00 Location Map - attached Reductions of all plans—attached Ariel view and picture of the RV Ballot Sheet - Attached Findings of Fact sheet, page 11 of the app - Attached Other Pertinent Information - Attached are pictures of other recreational vehicles, trailers and boats in the neighborhood. The HOA does not restrict RV's and there are no pending amendments. HOA dues are $25.00 ($2.08 per month) and people generally enjoy the peaceful eclectic feel. The former chief of police Mr. Barney has lived 4 doors down since around 1969. My mother has lived 6 doors down since 1973. A few have died or moved to assisted living,but nobody sells to live in a neighborhood with sidewalks, street lights, or conforming shingle colors. This neighborhood is grandfathered in many of the City's standards, however,this situation requires a variance. List of adjacent property owners from Auditor- Attached Check for City of Carmel $180.00 —enclosed Certificate of Mailing—Attached Placement of Public Sign Affidavit—Attached Petitioner's affidavit of Public Hearing—Attached Notice of Public Hearing Form—Attached Publisher's Affidavit—Attached Other review comments RV is 12 feet tall RV is 29 feet from the street. RV is 15 feet from the east property line. RV cannot be parked further back on the cite. RV is as close to the garage door and still allow garage access. The east side of the home is a drainage slope and the RV would be on top of the property line. The west side of the house is about 15 feet to the property line and again the RV would be on top of the property line. The RV cannot go further up the driveway to the side of the house due to an addition to the garage before the applicable Cannel Code. A privacy fence is agreeable to add with some landscape screening. Not sure this will be effective, or anyone will find it worth the effort. The practical difficulty is that there is no other place to park the RV on this property. This is a rural community with no street lights, sidewalks or curbs. Directly east across River Road is a horse farm and to the north on River Road is a waste water treatment facility. There are approximately 13 RV's and boats in driveways visible from the street, or about 10%of the homes. If there is a"grandfather" consideration this is a good application. Letters of support—Attached. The ordinance protects the homeowner that owns the property next to the RV. The homeowner next to the RV Mr. Dustin Marcum has signed one of the letters of support. Of the 9 adjacent homeowners, 6 sent written consent,the owner of the abandoned rental house in the back yard called and showed no objection, two did not respond. Additional Pictures—There are pictures of 13 more RV's parked in the neighborhood and it is believed we did not get pictures of all of them. This is an RV, boat, and trailer neighborhood. Location of RV—The RV has been moved as far back into the driveway as possible. Practical difficulties—Based on the additional to the garage and addition to the driveway which was added as an RV parking spot before the ordinance, practical and financial reasonableness point toward a variance. The home next door to the west is assessed at$148,000.00 and of the 14 houses on the street three have gravel driveways. Respectfully Submitted, A Darrell J.
