I believe the local zoning ordinance requires this as well. Angie Conn, can you confirm that the local zoning asphalt requirements for me? The IFC requires an all weather surface capable of supporting 75,000 lb fire apparatus to include aerial outrigger loading. With the freezing and thawing, along with wet weather conditions in this part of the county I've never known of a engineer willing to provide a letter to certify a gravel road for fire apparatus use in my 20 years of professional fire service experience. With the tight turn between the house and garage, we will need to see a fire apparatus auto turn for your proposed road to confirm your design will allow our equipment to get through that location. I will email you the specs for our equipment so the auto turn plan can be generated. I will send that to you in the AM as I am off duty today. What improvements and changes to the structure has the code consultant advised you of in order to comply with the Indiana Fire and Building Code? This is what we are thinking and willing to commit to at this time in terms of location, size, and design(especially for providing the turnarounds) for the required access to the pole barn. The only remaining item is whether or not this drive (whether all or a portion)has to be paved. The code consultant has shared that gravel could be used as a material as long as we meet certain compaction rates in order to accommodate fire apparatus. Are there any local ordinances that we might be missing which require a paved surface above and beyond what is contained in the IFC? At this time, we do intend to seek variance approval at the Feb. 25th meeting. Most of the information that was presented at the Jan. 28th hearing will be carried over to this next meeting; however, within the next few hours, I will be submitting some supplemental material per our conversation and the board's requests. I have copied you on some further correspondence with the BCS, CFD, Alternative Transportation, and Engineering over the past few days, but I would like to briefly review what has been discussed thus far: 1. BCS: During TAC, Building and Code Services mentioned that a bathroom will likely be required in the pole barn due to the fact that there is a change of use and it is converting to a Class I structure. The petitioner, with the help of a code consultant, intends to appeal this IBC rule to the State of Indiana with a formal variance process. Our argument will be that bathroom facilities exist in the house on the property and within a reasonable distance to the commercial structure and will be available during business hours for employee(s). If the petitioner is not successful with this appeal to the state, then the petitioner will be required to comply with the IBC and install bathroom facilities in the pole barn prior to a C of O being issued. I am awaiting further response from BCS. 2. CFD: I have had at least two conversations now with Chris Ellison of the CFD. It is unlikely this item will be resolved by the time we appear before the BZA. According to our code consultant, the International Fire Code (IFC) requires that a local fire authority be able to access a commercial structure within 150 feet of the most remote portion of the structure; however, it does not specify that this access be paved or give guidance on what material is to be used. Our code consultant is telling us that gravel can be used to provide access as long as we are able to meet certain compaction requirements in order to accommodate a 75,000 lbs fire apparatus. We will submit revised site plans and aerial photos showing the approximate locations of the drive with a "hammerhead" turnaround, per CFD. We are just trying to determine whether it will be paved or compacted gravel. 3. Alt Trans: I communicated with David regarding bicycle parking and the multi-use path. The petitioner has committed to paying into the thoroughfare fund and provided a quote to David/Alex for the estimated cost of installing that path approximately 148' along the frontage of the subject property. I am waiting to hear back from David regarding bicycle parking and whether or not we can allocate space in the pole barn and qualify that as satisfying the bicycle parking standard. 4. Engineering: My conversations with Alex and David have overlapped, especially surrounding the multi-use path. Alex raised a separate issue regarding the amount of disturbance caused by this project. I am waiting to 2 hear back on what qualifies as a "disturbance". The petitioner will continue to work with the Engineering Department to provide what is needed to satisfy all Engineering Department standards. As discussed earlier this week, the petitioner has some additional considerations for requesting even more time from the board and would like DOCS's support for a 10-year time-limited variance. We are open to discussions about what the city wants to have happen at the end of that time period. Our thoughts are that the area is unlikely to see catalytic change over the next 5-10 years. That said, the city has an interest in seeing this area redevelop and long-term the petitioner desires to be a stakeholder in the city's vision for 96th Street. It is possible that over the next 10 years the adjacent 3 acres could come under the petitioner's possession/ownership and that this entire 6 acres (at least 3 acres) be available for redevelopment consistent with the city's vision. Attached, please find a letter from the petitioner's bank to lend support to what I shared with you on Tuesday over the phone. Due to certain underwriting/financing considerations, the bank (and any financial institution) is not willing to finance anything less than a 10-year variance (they are barely comfortable with a 10-year variance). We hope to find a common ground between the petitioner and the city. As mentioned, I will be submitting some supplemental material for your review within the next few hours. Attached is our application and supplemental materials for your review and consideration. Essentially, the request, if approved, would allow for a printing/publishing establishment within the S2 Residential District specific to the property located at 2430 E 96th Street, Indianapolis, IN 46240. The petitioner would utilize an existing pole barn currently located at the rear of the property to operate the printing/publishing establishment. No new or additional square footage will be added. The existing home will remain a residence for the foreseeable future. The petitioner would like to add a gravel drive from the existing paved driveway serving the residential home to the pole barn and have a small area to turn around and park employee's cars. Planning Staff(including the Director) is comfortable with you submitting a BZA use variance petition/request for the rear barn/garage use, and Staff will most likely recommend to the BZA a 1-yr time limit on the approval, if approved.That way,the site and the use can be revisited in the near future, along with forming a master plan for this site and the 3-acre site next to it, where it might make sense at that time to do a Rezone. Also,there was a Staff suggestion that you do not add a gravel drive back to the barn so is there a way to not do that and just leave it as grass (to keep the site looking as residential as possible, with as much green space and as much tree preservation areas a possible)? But we do not want you filing for a BZA use variance (where the site would remain residentially zoned but just allow for this one specific non-residential land use), when you should be filing for a Plan Commission rezone (to change to a business zoning classification), instead. Please note that there are a lot of steps involved with the BZA public hearing process. Also,the Technical Advisory Committee (TAC)would also need to receive copies of your proposal, application, site plan, exterior architectural building elevations, drainage and parking plan, landscape plan,tree preservation, etc. For now, here is a link to the BZA webpage,which has the Calendar, Flowchart of the Process, link to Applications,etc. (The Use Variance Application also includes an Instruction sheet, as well as a Checklist.) I figured this would help you gather thoughts before we discuss over the phone. 1. Background: My client is PIP Printing located in Carmel at 11711 N Pennsylvania Street, Suite 107. PIP has been in Cannel for over 40 years and in the last 12 years has grown from 3 employees to 10. They are currently occupying just under 3000 sq/ft of retail office space. 2/3 of the current space is being used for printing, mailing, sign making, and design. We are experiencing 25% annual growth in signage requiring us to upgrade some of our inkjet printing equipment. Our current space simply does not have room for the printer we are looking to purchase. Our intent is to keep PIP at our current location and use the barn at 2430 E 96th to facilitate the growth in our sign sales. 2. Would your client be living there, as a Home Occupation? Or, would they use the entire site commercially? The idea is to rent out the existing house or possibly move into it initially. It is towards the front of the property. The Barn is about an acre back from the road is where we intend to replace the current welding & woodworking equipment with a quieter inkjet printer to print yard signs. 3. What is the proposed commercial use? Office, retail, restaurant, other? We are out of space here at PIP to be able to efficiently print and laminate yard signs we intend to move the sign printing portion of our business to the barn on the property. 4. How many employees are proposed, and what are the hours of operation? There will only be 1 -2 employees between normal 8:30 — 5:00 business hours. 5. Would they use the existing house? Or,will a new structure be built in its place? The existing house will remain a residence until we are able to purchase the 3 acres adjacent and develop the property in line with Carmel's plans for that area in the future. 6. How will you address stormwater detention/drainage, parking& traffic flow, lighting, landscaping/buffering, tree preservation, signage, etc.? This will not be a location that will have any customer traffic coming or going. The only renovations we are planning for the existing building are internal such as improving the HVAC and insulation. The current layout of the property, the woods, and placement of the building provides a natural buffer. 9. The adjacent 3- acre site is currently owned by my client's grandfather and will be eventually joined with the 3 acres we are purchasing for a total of 6. The adjacent owner is not ready to move/sell but he is excited to have us as neighbors and looking forward to future development. Since the 6 acres are a deep lot my clients are interested in input from the City to guide the future development of the area. My client envisions possibly using the area closer to the road as office space and transitioning into light manufacturing or multi-use space as you move back from the road. Their plan immediately is to utilize the property for their sign printing and as a residence while the surrounding area is transitioning to a more commercial setting.
