Dear BZA Hearing Officer,
We are currently building a new home in the Stableside section of Jackson Grant
subdivision, at 529 Dickson Lane. We strenuously oppose the variance filing for
Lot 274 (528 Terhune Lane) that would decrease the side setback. When we began
building in this neighborhood, we understood that the 5 -foot side setback was a
zoning standard that would be maintained by the builder. We strongly feel that the
builder should not be allowed to violate this minimum standard.
The 5 -foot side setback in both the City of Carmel ordinance (26.04) and the
development ordinance (Z-533-11, Section 6.1) are defined to maintain the
integrity of our neighborhood. A smaller setback will negatively impact the
overall appeal of our neighborhood. This proposed change should not be imposed
on the neighboring homeowners, as it unjustly diminishes their property value
from the standpoints of noise level, crowding of the already narrow lots, and
exterior lighting. Anything less than a 5 -foot side setback is also a potential fire
concern. We will soon be moving into our new home being constructed on Lot
270. One lot adjacent to ours is vacant, and we could well be subjected to this
same unwarranted reduction of our property value if the builder chooses to
disregard this zoning regulation when that lot is sold.
We request that you uphold the ordinance requiring the 5 -foot minimum for a side
setback.
