Depending on the proposed location and/or lot coverage, you may or may not need to seek BZA Variance approval. Also, will your lot coverage increase to be greater than 50%? Attached is one of the proposed site plans that was forwarded to me back in February. The setbacks for this version comply with the zoning ordinance. I just need to know the proposed lot coverage percentage. (All building footprints and impervious surfaces would count toward that number.) I would also like to invite a Pools of Fun representative to to that meeting to discuss our pool layout and possible easement encroachment. Papers have been filed with Jarrod Huff and are available with his office. Those papers where filed with a different pool company but we are now going with Pools of Fun. The pool layout is about the same location with similar design in mind. If you would please contact me as soon as you can so we can set up a meeting early next week if possible. We will bring our Plot Map and design drawings to the meeting for discussion. 1 Please let me know if you need anything else specific before the meeting. I have approval from the HOA for Subdivision Approval and what ever the city requires. I think I will need to bring my contractor (Matt Buck/Family Leisure) in to this picture to address the layout issues. I think we will want to add some bushes, maybe take some of the dirt and have a few small berms for landscaping as we have now in the backyard. I will have Matt Buck, at Family Leisure contact you and/or Joe Shestak who is our Managing Architect doing the drawings and has some measurements where pool might go depending on approvals. His number if needed is 317-363-7202. Is this what you would recommend for the next step or should I being doing something else to help the process through? This does make things easier. If you are building the pool or accessory structure within the easement (or up to within 3-feet of the easement), you may also require a Subdivision Standards Variance from Planning and Zoning. If you are building anything (including landscaping) within the easement, then you will need the Consent to Encroach agreement. A Consent to Encroach is pretty easy to obtain, but the Subdivision Standards Variance, if needed, can be a lengthy process, so it is always recommended to follow the standards. I have copied Angie Conn to this email who may be able to weigh in as well. The only additional information that is needed to proceed with either of these is to have your landscaping plan plotted with the easement and property lines.
