We are NOT in support of the variance filing for Lot 274 (528 Terhune Lane) to decrease the side setback. The 5 foot side setback has been a necessary requirement. The neighborhood is close to being built-out and to allow this now does not support the design and lot standards imposed on all home owners. Driving past I noticed the bump-out on the house has already been constructed. The builder is obviously anticipating your approval, but please note, you are not responsible for the builder's $$s in the house. We hope you are responsible to the existing neighborhood as a whole. A few additional thoughts, 5 feet to the lot line is not much for our houses. Then to cheat on that by bumping-out the house (without a supporting foundation) is not fair to the neighborhood, and especially to the neighbor. What rules would accompany an approval? I can't think of a limit. Would this be allowed if there was a supporting foundation? What if both neighbors want a bump-out in the same adjoining location? What about a bump-out to accommodate a stairs landing in the middle of a wall, a bedroom on any floor, a bathroom on any floor, a closet on any floor, either side of the house, a hallway, what's the rhyme or reason? What about over a window well - will there be access or exit from the well? How long can the bump out be; how close to the property line can it be? How much roof over-hang can there be that decreases the distance between houses? What safety factors to consider? What about a window well at the neighboring house that a person is forced to step towards to avoid the bump-out? What about the neighbor's privacy? etc... There are no additional questions or rules or discussion needed when the 5 foot side set-back rule is used. Please keep it simple and reject the bump and support the existing 5 foot side set-back.
