Re: Docket 19010011V PUD Ordinance Z-533-11, Section 6.1
We live in Jackson's Grant subdivision in the Stableside section. We are NOT in support of the
variance filing for Lot 274 (528 Terhune Lane) to decrease the side setback. When we built in this
neighborhood, we understood that the 5 foot side setback was a necessary requirement. We believe in
this minimum standard and want it to be enforced.
The 5-foot side setback in both the City of Carmel ordinance (26.04) and the development ordinance
(Z-533-11, Section 6.1) are defined to maintain the integrity of our neighborhood. Less than 5 foot
setback will negatively impact the overall appeal of our neighborhood. This is important to us for
from the stand point of property value, noise level, natural lighting for our developer's required
extensive side yard landscaping, and lighting for our homes. Anything less than a 5 foot side setback
is also a potential fire concern.
When building our home we agreed to follow all of the City of Carmel ordinances and the
development ordinances, even if we didn't agree with them, some as trivial as the number of
landscaping plants and trees necessary for our yard. We feel like this setback ordinance is much
more critical and when the homeowners agreed to build in Stableside, they also agreed to follow the
designated ordinances!
Please uphold the ordinance requiring the 5 foot minimum for a side setback.
