Re: Docket 19010011V PUD Ordinance Z-533-11, Section 6.1
We currently own Lot 265 and have a home under construction in the Jackson’s Grant subdivision in the Stableside
section. We are NOT in support of the variance filing for Lot 274 (528 Terhune Lane) to decrease the side
setback. When we bought a lot and contracted to build in this neighborhood, we understood that the 5 foot side
setback was a necessary requirement. We feel strongly that this setback requirement should be upheld.
The 5-foot side setback in both the City of Carmel ordinance (26.04) and the development ordinance (Z-533-11,
Section 6.1) are defined to maintain the architectural integrity and visual appeal of our neighborhood. By allowing a
variance to decrease the setback, the overall visual appeal of the Jacksons Grant subdivision will be negatively
impacted. In addition, approving this variance will set a precedent to allow others to do so as well which will
decrease the property values for all homeowners in the Stableside section of Jacksons Grant. This is important not
just from the standpoint of property value, but will also create potential issues with noise level, interference with
appropriate side yard landscaping, and proper lighting for our homes. Anything less than a 5 foot side setback is also a
potential fire concern.
With that in mind, we respectfully ask that you please deny the requested variance and uphold the current ordinances
referenced above which require the 5 foot minimum distance for a side setback.
