We are NOT in support of the variance filing for Lot 274 (528 Terhune Lane) to decrease the side setback. We built in this neighborhood with the understanding that a 5-foot side setback was the necessary requirement. The 5-foot side setback should be the absolute minimum standard. The 5-foot side setback in both the City of Carmel ordinance (26.04) and the development ordinance (Z-533-11, Section 6.1) are defined to maintain the integrity of our neighborhood. A setback of less than 5 feet will negatively impact the overall appeal of our neighborhood. This 5-foot side setback minimum is important from the stand point of property value, noise level, lighting for our required side yard landscaping, and lighting for our homes. As well as, the safety needed to exit an egress window well in the event of an emergency!! Anything less than a 5-foot side setback is also a potential fire concern.
