Here is the contact info for Caleb Warner and Jeremy Kashman (City Engineer) in the Carmel Engineering, Dept.: cwarner@carmel.in.gov and jkashman@carmel.in.gov and 317-571-2441. Caleb can advise you on the process to get curb cut locations requested and approved; their department will be the liaison between you and the Board of Public Works&Safety. Caleb &Jeremy can also advise you of the requirements for spacing and locations of curb cuts, and also whether or not they would be supportive of such requests. I assume that you are just doing your due diligence,for now, to find out what the process is to get curb cuts approved, correct? The reason I ask this is that there is not a Plan Commission-approved site plan yet, for these parcels.The project still needs to go through DP and ADLS reviews and approval, after the pending rezone process. And, that site plan (including drive locations) will most likely need to be approved, first, or be close to being approved, before the Engineering Dept. and the BPW would consider your request for curb cut locations. I have attached both evaluations.The chart on the first evaluation was also wrong. I know the results are the same, but what should be done is to switch the chart and double check the wording(%and tree size)to be right throughout the document.The woodland breakdown attached is what I originally emailed and what should be put in the evaluation. I think you had the old chart in your files and used it instead. PLEASE let me know if you have any questions, but I think I figured this out. I was looking back at it for reference for another project and saw the wrong chart. It's my understanding that the Commercial Committee voted last night to send this case to the Plan Commission with a Favorable Recommendation. I'm trying to advise the land owners/sellers regarding the dates of the future zoning hearings. My notes indicate that the next Plan Commission meeting is November 20, 2018 and that the City Council meeting following that is December 3, 2018. If I could get a layout of the open space master plan for the entire site that would be great—a sample is attached. In this case, an existing site plan along with a proposed one with the buildings, parking and woodlands to be saved would be beneficial. Also, please map the woodland areas with the woodland breakdown as the types of woods—see woodland breakdown capture attached. A brief woodland evaluation and description of the different areas with picture captions would suffice. Like you said note the different areas; for example, areas of larger trees, areas of dead ash, areas of early successional trees vs hardwoods, or areas adjacent to homes or the roads. I also attached our tree preservation guidelines and for reference our open space ordinance. Let me know if you have any questions, my number is below. In your staff report at the hearing on Tuesday of this week you expressed a desire that all of the 31 lots comprising the Meridian Suburban neighborhood be assembled with the 6.16 acres I am trying to rezone to create a new parcel for commercial development. The problem with doing that is that the land owner has tried two times in the recent past to do that, first with his attorney, Zeff Weiss and then with his realtor Mike Drew. Mike Drew indicated to me that both attempts were not at all fruitful. What Mike concluded from the exercise is that the folks that live in the neighborhood like it there and would, if displaced, have a difficult time finding comparably priced housing in Carmel. Because of this history, we determined that any such attempt to purchase would likewise be futile. Of course, the City could attempt to acquire the property by eminent domain, but that effort would take quite a while to complete. We are not interested in waiting out that process. For this reason, we believe that the project we bring is one that can be made compatible with the adjoining neighbors and we believe that the lack of a strong remonstrance on Tuesday is evidence of that. I believe this plan was called Valley Development Co., Inc., MC Rezone: Docket No.18030016 Z, and is now known as Franciscan Health Orthopedic Center of Excellence, MC Rezone. My fiancé and I reside at 10901 Tottenham Drive, in the neighborhood directly adjacent to the north to this parcel of land. If the plan went through for rezoning and development, we would be the second house from the proposed residential/commercial property line. Because of our close proximity to the proposed project we have a few concerns in relation to ordinances outlined in the City of Carmel Unified Development Ordinance. 1. Section 2.39 and 2.40 state under the intent and permitted uses of the Meridian Corridor that the corridor "is not intended to be used where it would conflict with suburban residential areas. However, it 1 may be used adjacent to such residential areas when exceptional means to properly transition from such uses is fully utilized. Additionally, lighting,noise, traffic, odors, and height transitions should be strictly regulated to protect low density neighborhoods."If a building were to be permitted this close to our neighborhood,how would the our neighborhood be protected from the noise, light, and traffic increase that comes with the removal of the trees and erection of a commercial building and possibly a parking garage? As part of the DP/ADLS process(a later procedure), steps will be taken to minimize impact on the adjoining residential parcels. The MC district does not, in this area of the Meridian Street Corridor, permit primary buildings (i.e.,the hospital and MOB)that are less than 4 stories, unless the building will be within 100 feet of a residential district in which case the building cannot exceed 2 stories. The building will be more than 250 feet away from the residential area. The maximum permitted stories for this parcel are between 8-11, so the impact of 4 stories vs. 8 is favorable to the adjoining neighborhood. 2. Section 5.07 states "Any parking garage associated with an MC District development shall be located in an inconspicuous location on the site and be buffered with shade trees, or shall be skinned with an architecturally designed building facade complementary to adjacent buildings." If there were to be a parking garage, do you know where it would be located on the parcel of land?Approximate location is shown on the site plan. If it were to be located on the north side adjacent to residential property lines would that be considered a conflict with suburban residential areas?It will not be located on the north parcel. If it were to be located on the south side, and the commercial building were to be located on the north side, would the height standards in Section 5.17 apply, where within the 100 feet of a shared property line a commercial building could not exceed two stories? A parking garage on the south parcel within 100'of the residential area is permitted by the existing MC district as long as it is not more than 2 stories tall and not more than 18'tall. Any taller structure would require a variance and would be subject to a separate variance procedure. 3. Section 5.29 and 5.34 relate to parking standards in the Meridian Corridor. It states that "parking spaces cannot be closer than five feet to any lot or parcel located in a residential district or used for residential purposes."If ground level parking spaces were to be within five feet of residential property lines, how would this be considered a proper transition between residential and commercial property?A 30'buffer is planned and is required. No parking will be closer than 30' from adjoining residential districts. Furthermore,the majority of parking lots are well lit with street lights. From where our house is located, the parking lot lights would be easily seen and could definitely shine unwanted light onto our property at night. During DP/ADLS there will be work done to minimize this impact. 4. Most importantly, our major concern regards our water supply which I believe is somewhat addressed in Section 5.76. To my best knowledge, our whole neighborhood has individual well pumps on each residential property. Our pump supplies our house with water for faucets, showers, and outdoor water fixtures. Our sewer system is connected to city water. How would the construction of this proposed building affect our neighborhoods water supply and/or the water table?I am not an expert in this matter by any means,but it seems likely that our water supply could be affected if major construction were to take place very close to our residential property. Efforts will be undertaken to ensure that there is no harm done to the drinking water supply of adjoining properties. 5. Additionally, I could not find ordinances regarding connecting residential roads to a commercial property road.No connectivity is planned. The end of Tottenham Drive is currently a dead end. Would it be possible for the developer to somehow merge Tottenham Drive to their property?Perhaps possible, but not part of the plan. If so,this would likely create an undue burden on our neighborhood with increased commercial traffic going into the proposed development. Also, if the rezoning were permitted and construction commenced on this parcel, would construction traffic be barred from entering the parcel via Tottenham Drive?Yes. In the past we have had large construction/utility vehicles block driveways while going onto the parcel. 6. Do you know if the developer is looking at buying houses within our neighborhood because of all the zoning restrictions imposed by the City of Carmel Unified Development Ordinance for commercial properties that share property lines with residential properties? We are open to discussing this, but all of 2 the homes would need to be acquired in order for this to make sense. It does not make sense to acquire less than all of the homes. I know these questions may be better suited for the meeting with the developer on September 18th, 2018, but if you are able to shed any light on them before the meeting it would be greatly appreciated. Phase I is estimated to be 30 months. Ortho-Indy operates medical offices at St.Vincent Carmel. IU Health Saxony offers orthopedic services in Fishers.St. Vincent, Fishers,offers orthopedic services.Therefore,there is adequate orthopedic services available at or near Carmel.One would question why another orthopedic facility is needed in this community. Franciscan too is already a provider of orthopedic services at its Carmel Hospital and its feasibility study concludes that there is a need for this. The Project also aims to respond to the anticipated tremendous growth in demand over the next ten years,fueled by an increase in life expectancy,the aging baby boomer population, and medical tourism pushed by many self-insured employers.The location is also an attractive option to pull from other portions of the state. 1 Franciscan Health may be better served to build such a facility within Marion County with a desired location in the inner city, Indianapolis Westside or any other area that meets the needs of that community.There is a definite shortage of hospitals, medical clinics, health services,etc.within the greater Indianapolis community. Indianapolis already has an orthopedic specialty hospital—Ortholndy in Pike Township. I realize there is tremendous competition among the major healthcare players in this market. Between St.Vincent, Community Health Network, IU Health and Franciscan Health they continue to build, expand, purchase facilities, etc. One must ask, are they really interested in serving the community or in making money? Serving the needs of patients is and has been the core and primary mission of Franciscan from the beginning. While I recognize the desire of Carmel to generate tax revenue, is this the best we can do? Does Carmel need another hospital/medical clinic? Or can the same tax revenue need be met with another option. This is not really another hospital. It is a relocation of an existing hospital already in Carmel,just a response to the determined need. Do these not-for-profit institutions truly generate tax revenues, other than income taxes paid by employees? This particular project will generate property tax revenues. How many of those employees live in Carmel or Hamilton County? Will the retail spaces compete with existing for-profit entities for business?The two story building that is shown is a medical office building. Whether retail will be included is not known for sure, but the plan is that any such retail would be related to or serving the medical population on the campus. Who owns the property?Valley Development Services. Is it the group in Florida (yes) or Franciscan Health? How much, if any, real property taxes will be paid?This is dependent upon the total assessed value of the project. And by which entity? Any and all occupants of the project including Franciscan Health. As a newcomer to Carmel, moved in August 2018, I believe in competition and free enterprise. It appears to me that Carmel is overbuilt with hospitals, medical facilities, apartments, condos,townhouses and office buildings.Already addressed above. Many store fronts are vacant. Apartments are being constructed throughout Hamilton County. How many will sit empty in the coming months due to oversupply?Grocery stores are vacant but building continues.At what point does the city take a "time-out"? Cannot speak to these observations, only to this particular project. I read in the document that Carmel wants to preserve neighborhoods. Does a multi-story building next to neighborhoods meet that goal?The City already zoned the southern 12 acres to the MC district. That district already allows for an up to an 11 story building where we are showing the hospital/MOB building, but we will limit the height of the hospital/MOB to no more than 4 stories. Lights will be illuminated 24/7. Measures will be taken to mitigate. A three to five story building will tower over existing neighborhoods.Again, the City made this decision when it rezoned the 12 acres to MC. The height of buildings on the 6 acre tract is limited to 2 stories and we will comply with that. Is that desirable for residents of those communities who also pay property taxes? When the time comes for taking this project through the DP/ADLS process, appropriate measures will be considered and employed to reduce the impact on the adjoining residential parcels. What about the continuing mounting city debt?Yes, it is backed by property taxes, paid in large part by resident homeowners. Bond ratings are good for now. Is the city prepared for an economic turndown? Lower bond ratings?Good times will not continue ad infinitum.Cannot speak to these observations. I recommend the planning commission turn down this request for rezoning. Respectfully, we believe that a 4 story medical facility on the south and a no more than 2 story building on the north is a better result than an up to 11 story commercial building on the south parcel. Considering what could be located here, this is a good use that is being planned to reduce as much as possible impact on adjoining neighbors. Look for other stakeholders that add needed value to the community.Another hospital and medical complex are not needed in Carmel. This is not consistent with the known demand for orthopedic services for the over 65 population in the next 10 years. 2 However, I know big business, with large amount of capital, plus political influence and power often win these battles. You also made reference to the AR standards at 5.07.D indicating that the lot was of moderate width requiring that 75%of the lot's width would need to be covered by the principal building(s). I think I agree with your logic, but wanted to make sure I follow it: If we apply the 75% rule (or even the 80% rule for narrow width lots), doing so puts the building closer than 100 feet from the adjoining residential district. Therefore,we will be filing for a rezone of the north 6+/-acres from S-2 to MC. Given that we have met with you twice on this project, I am assuming that we have met the requirement of an initial discussion. I will provide a draft copy of the application later today so that you can see what we are doing. There is no present design or development contemplated for this parcel given that we are trying to push the improvements(e.g., parking garage)to the southern parcel which is zoned MC. B. Additional Stories: Additional stories shall be permitted if any of the below criteria exists or is committed to by the developer. However,the absolute maximum number of stories shall be eleven(11)when not within 100 feet of a single-family residential area. 1. I think this is potentially responsive to the mayor's comments in the meeting. However, as I read the MC ordinance (sections 2.40 and 5.17), I am concluding that a free-standing garage is an accessory building and if that is correct,we are limited in height to 18'. Even though we are showing a 4 story garage, we are thinking that we would not want it taller than the principal buildings,so 3 stories is more the direction that I believe we are headed in.
