HomeMy WebLinkAboutInfo Packet submitted to Staff 07-12-96 • CITY OF CARMEL AND CLAY TOWNSHIP BOARD OF ZONING APPEALS APPLICATION FOR SPECIAL USE -- INSTRUCTION SHEET Allow plenty of time for the Department of Community Development (DOCD) staff review and Board of Zoning Appeals (BZA) approval Process (approximately 45-60 days). Discuss proposed Sign Variance with the DOCD staff (please call for an appointment; 571-2444, Third Floor, Cannel City Hall, 1 Civic Square, Carmel). 2. INFORMATION NEEDED for formal DOCD staff and BZA review (per section 30.5 of the Zoning Ordinance): a. Need the original and one copy of the completed variance application (available from the Office of DOCD), with legal description(s) attached. b. Need seven (7) copies of location map (five for the Board member's packets and one for each application form) showing location of site in question, zoning, and existing land use of all adjacent properties. /\ c. Need seven (7) copies of all plans (two full size-one for each application and five reduced copies-one for each Board member's packet) drawn to scale with all dimensions and depicting all existing and proposed structures, elevations, landscaping, drainage, lighting, signage, and any other supportingrP documentation to fully understand the proposal. d. Need five (5) copies of statement of sign variance (question number 7), statement of practicalcts 00`" difficulty (question number 8), and both Findings of Facts sheets (respond to questions on quest.0 sheet only and fill in petitioners name on both), these copies are for the Board Member's packets" e. Need two (2) copies (one with each application form) of adjacent property owners certified by the Hamilton County Auditors Office. 3. The above referenced information must be submitted to the DOCD at least forty-five (45) days prior to hearing date. Within ten (10) days, the application will be reviewed by staff and a letter outlining the deficiencies will be mailed to the petitioner or a docket number will be assigned (a docket number will not be assigned until all deficiencies are addressed). 4. After final review the petitioner will need to pay the required filling fee at which time the docket number will be released. 5. At this time, the Notice of Public Hearing must be mailed to all adjacent property owners and published in the Noblesville Ledger a MANDATORY twenty-five (25) days prior to the public hearing date and should be published on the next available publication dated of the Carmel News Tribune. 6. At least ten (10) days prior to the hearing, the petitioner must submit their proof of publications, proof of adjacent property owners notice, a completed Petitioner's Affidavit of Notice of Public Hearing, and the Board member's packets to the DOCD (a minimum of five packets are needed). The following is the order and list of items that should be included in the each Board Member's packet: 1-Finding of Facts (ballot sheet) 4-Statement of Support 2-Finding of Facts (question sheet) 5-Location Map 3-Statement of Special Use 6-Reductions of all plans (site, drainage, landscaping, signage, lighting, etc...) and elevations 7. The property owner, property owner's Attorney, or someone with the property owner's Power of Attorney must be present at the Carmel/Clay Board of Zoning Appeals Public Hearing. 8. A presentation must given at the public hearing. This should include some type of display or exhibit, an overhead transparency projector and laser pointer will be available the night of the hearing. 9. Generally, special use applications are acted upon by the Board in one meeting. However, the Board at its' discretion 1111 at any time may table an item. 10. The Board of Zoning Appeals meets the fourth Monday of each month at 7:00 p.m. in the City Council Chambers, 2nd floor of City Hall, 1 Civic Square, Carmel, Indiana. s:\forms\instrsp.use 10/13/95 • 21.3 Basis of Board Review. The Board, in reviewing the special use application, shall give consideration to the particular needs and circumstances of each special use application and shall examine the following items as they relate to the proposed special use: 1. Typography 2. Zoning on site 3. Surrounding zoning and land use 4. Streets, curbs and gutters and sidewalks 5. Access to public streets 6. Driveway and curb cut locations in relation to other sites 7. General vehicular and pedestrian traffic 8. Parking location and arrangement 9. Number of parking spaces needed for the particular special use 10. Internal site circulation 11. Building height, bulk and setback 12. Front, side and rear yards 13. Site coverage by building(s), parking area(s) and other structures 14. Trash and material storage 15. Alleys, service areas and loading bays 16. Special and general easements for public or private use 17. Landscaping and tree masses 18. Necessary screening and buffering 19. Necessary fencing 20. Necessary exterior lighting 21. On-site and off-site, surface and subsurface storm and water drainage 22. Utilities on-site and to the site 23. Deduction of streets and right-of-way 24. Proposed signage (subject to regulations established by the sign ordinance), and 25. The Special Use will be consistent with the Character and Permitted Land Use of the zoning district and CarmeUClay Comprehensive Plan because: the use is consistent with residential development and is similar in nature to schools and churches commonly found in residential areas. 3.
