COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Jeff Worrell; Council Members: Laura Campbell, Ronald E. Carter, Anthony Green, Sue Finkam, H. Bruce Kimball, Kevin D. Rider and Deputy Clerk Jacob Quinn were present. Council President Worrell called the meeting to order at 6:00 p.m. AGENDA APPROVAL Two items added to the agenda under Agenda Add-On Items INVOCATION Pastor Brandon Faust, Mercy Road Church, delivered the Invocation. Councilor Carter led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS Chief David Haboush, Carmel Fire Department, recognized retiring Firefighter/Engineer Ken Brant. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS There were none. CONSENT AGENDA Councilor Finkam moved to approve the consent agenda. Councilor Carter seconded. There was no Council discussion. Council President Worrell called for the vote. The motion was approved 7-0. a. Approval of Minutes 1. January 7, 2019 Regular Meeting 1 2. January 23, 2019 Special Meeting b. Claims 1. Payroll 2. General Claims $2,445,654.87 3. Retirement 4. Wire Transfers ACTION ON MAYORAL VETOES There were none. COMMITTEE REPORTS Councilor Finkam reported that the Finance, Utilities and Rules Committee had met. Resolution CC-12- 17-18-04 passed with appositive 3-0 recommendation but remains in committee. Likewise, Ordinance D- 2450-18 remains in committee. Ordinance D-2451-18 is returning to Council with a positive 3-0 recommendation. Councilor Green reported that the Land Use and Special Studies Committee had met and both items remain in committee. OTHER REPORTS—(at the first meeting of the month specified below): Henry Mestetsky, Executive Director of the Carmel Redevelopment Commission, gave the monthly report. Bob Swaney, Director of the Carmel Clay Public Library,presented the annual report for the Library Board. Michael Klitzing, Director of Parks and Recreation, gave the quarterly report. John Robbins, Executive Director of the Hamilton County Leadership Academy, gave a report to Council. OLD BUSINESS Councilor President Worrell announced the Fourth Reading of Ordinance D-2448-18; An Ordinance of the Common Council of the City of Carmel, Indiana,Amending Chapter 6, Article 5, Division VIII, Section 6-158 of the Carmel City Code; Sponsor: Councilor Carter. Item remains in the Land Use and Special Studies Committee. Councilor President Worrell announced the Third Reading of Ordinance Z-638-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning 6.16 acres at SE Corner of North Illinois Street and 111th Street From S2 (Residential)to the MC (Meridian Corridor) District; Sponsor: Councilor Campbell. Item remains in the Land Use and Special Studies Committee. 2 Councilor President Worrell announced the Third Reading of Ordinance D-2450-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Sections 8-47 and 8-48 to Chapter 8, Article 5 of the Carmel City Code; Sponsor: Councilor Worrell. Item remains in the Finance, Utilities and Rules Committee. Councilor President Worrell announced Resolution CC-12-17-18-04: A Resolution of the Common Council of the City of Carmel, Indiana,Amending the Contract With the Carmel Professional Firefighters Association; Sponsor(s): Councilor(s)Rider, Campbell, Finkam, Green, Carter, Worrell and Kimball. Item remains in the Finance, Utilities and Rules Committee. Councilor President Worrell announced the Third Reading of Ordinance D-2451-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 1, Division III, Section 2-13 of the Cannel City Code. Councilor Finkam announced that the item was returning from the Finance, Utilities and Rules committee with a 3-0 positive recommendation. Councilor Finkam moved to approve Ordinance D-2451-18. Councilor Rider seconded. There was no Council discussion. Council President Worrell called for the vote. Ordinance D-2451-18 was approved 7-0. Councilor President Worrell announced Resolution CC-01-07-19-01: A Resolution of the Common Council of the City of Cannel, Indiana, Recognizing Additions to the Historic Contributing Buildings Survey as Recommended by the Cannel Historic Preservation Commission; Sponsor: Councilor Carter. The Item remained Tabled. PUBLIC HEARINGS Councilor President Worrell announced the First Reading of Ordinance Z-639-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the 2724 E 136th St. Planned Unit Development District. Councilor Campbell moved to introduce the item into business. Councilor Rider seconded. Councilor Campbell introduced the item to Council. Justin Moffett, Old Town Design Group, presented on the item to Council. Council President Worrell opened the public hearing at 7:40 p.m. Michelle Krcmery addressed Council. She stated that a lot of improvements have been made to the project and they appreciate the work of the petitioner, but the ongoing concern is the total number of units and density. Sharon Gratigny echoed what the previous speaker had stated and appreciates the additional buffer,but would like Council to take the density into consideration. Babette Miller expressed concerns about the project adding density to the area. Chris Lowery echoed the other speakers expressing concerns about the traffic that this project would add. Nancy Houser expressed concerns about losing her unobstructed view and the noise that would be added by developing the land. Seeing no one else who wished to address Council, Council President Worrell closed the public hearing at 7:49 p.m. Council President Worrell referred the item to the Land Use and Special Studies Committee. 3 Councilor President Worrell announced the First Reading of Ordinance Z-640-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending a Variety of Standards, Procedures, and Defmitions in the Unified Development Ordinance. Councilor Campbell moved to introduce the item into business. Councilor Rider seconded. Councilor Campbell introduced the item to Council. Adrienne Keeling, Department of Community Services,presented the item to Council. Council President Worrell opened the public hearing at 8:14 p.m. Seeing no one who wished to address Council, Council President Worrell closed the public hearing at 8:15. NEW BUSINESS Councilor President Worrell announced Resolution CC-02-04-19-01: A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Transfer of Funds From the 2019 Mayor's Office Budget Into the 2019 Department of Administration Budget. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. Jim Crider, Director of Administration,presented the item to Council. Councilor Rider moved to approve Resolution CC-02-04-19-01. Councilor Finkam seconded. There was no Council discussion. Council President Worrell called for the vote. Resolution CC-02-04- 19-01 was approved 7-0. Councilor President Worrell announced the First Reading of Ordinance D-2454-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division II, Section 6-88(a) of the Cannel City Code. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded. Jon Oberlander, Assistant Corporation Counsel,presented the item to Council. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Kimball seconded. There was no Council discussion. Council President Worrell called for the vote. The motion was approved 7-0. Councilor Rider moved to approve Ordinance D-2454-19. Councilor Campbell seconded. There was no Council discussion. Council President Worrell called for the vote. Ordinance D-2454-19 was approved 7-0. AGENDA ADD-ON ITEMS Councilor President Worrell announced Resolution CC-02-04-19-02: A Resolution of the Common Council of the City of Carmel, Indiana. Amending the Contract With the Carmel Fraternal Order of Police Lodge 185. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded. Councilor Finkam presented the item to Council. Councilor Worrell referred the item to the Finance, Utilities and Rules Committee. Councilor President Worrell announced the First Reading of Ordinance D-2455-19; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Ordinance D-2436-18. Councilor Rider moved to introduce the item into business. Councilor Finkam seconded. Councilor Finkam presented the item to Council. Councilor Worrell referred the item to the Finance,Utilities and Rules Committee. OTHER BUSINESS 2018 Encumbrances in 2019 - $13,293,760.59 (Acknowledgement Only) 4 Councilor Finkam moved to acknowledge. Councilor Rider seconded. There was no discussion Council President Worrell called for the vote. The motion to acknowledge was approved 7-0. ANNOUNCEMENTS There were none.
