Rezone
Docket No. 1-87Z, a Rezone Application for a parcel of ground 5.308 acres
in size located at the Southeast corner of 116th Street and Pennsylvania
Street, Clay Township, IN. Request is to change the zone classification
from an existing R-1, residential district, to a B-7, retail commercial
office district.
PETITIONERS PRESENT: Jim O'Bara, Engineer; Tim Paris, Keith Bonhanarder,
Dave Coots.
o Presentation was given by Mr. Coots.
o Recommended land use plan indicates moderate density residential/
buffer for this area.
o Important that this site is developed compatable with and does not
adversely affect the adjacent single family residential area to the
East and and set a precedent for the vacant R-1 land to the South.
o 5.3 acres was a part of a larger existing 16 acre parcel; TAC would
recommend concept development of the entire area in order to ensure
capatability.
o Final development plan under B-7 will come back to Plan Commission and
TAC if rezone is approved.
o Drainage: Propose that all on-site storm water would drain to the
North, per Kent Ward and Tom Welch; existing condition is that site
drains 1/2.to North, 1/2 to Southeast.

o Dry detention ponds proposed.
o Subsurface drainage proposed for storm water detention areas.
o Site drainage would tie into existing Fertig County Legal Drainage
System.
o Per Kent Ward, Fertig legal drain has capacity to accept storm run-off
from this site as long as on-site storm water retention/detention
areas are developed.
o Proposed drainage concept is compatable with overall plan for Fertig
Drainage area.
o Status of Washington Blvd. needs to be resolved, R-O-W, pavement,
drainage, etc.
o Pennsylvania Rd. is a private road at this time. Petitioner needs to
check with current owner in order to coordinate good road system to
serve this entire area.
o Indianapolis water proposed for this project.
o Sewer - Clay Regional Sewer District will serve area. Conditional
approval from Clay on file; no temporary sewer facilities proposed.
o Required B-7 30 ft. buffer area is measured from the edge of the road
right-of-way.
TAC members need more technical information before making a decision on
technical matters concerning proposed project.

Section One, consisting of 19 lots on 14. 75 acres of land. Site is zoned
S-2 and is located on the S.W. corner of W. 131st Street and Springmill
Road in Clay Township, IN.
PETITIONERS PRESENT: Joe Sharp, Dave Sexton
o Submitted Secondary Plat and Development Plan; conforms with approved
Primary Plat 79-86 P.P. (November 1986).
o Show lot widths on curves, building setback lines on Development Plan.
o All 131st road improvements will be installed by developer.
o Indianapolis water proposed.
o Clay Regional Sewer District will provide sewer service. Will need
final approval of Board.
o Temporary sewerage facility, if required, will be per temporary
holding facility, approved by Clay Regional Sewer District and
required State offices.

Docket No. 4-87 S.P. , a Secondary Plat application for Springmill Streams
Section Six, consisting of 25 lots on 20.79 acres of land. Site is zoned
S-1 and is located on the East side of Clay Center Road, South of S. 131st
Street in Clay Township, IN.
PETITIONERS PRESENT: Joe Sharp, Dave Sexton
o Submitted Secondary Plat and Development Plan; conforms with the
approved Primary Plat 80-86 Y.P. (November 1986)
o Mr. Sweet, the developer, proposed to increase the right-of-way from
50 feet to 70 feet along May Lois lane to Section 7 for a distance of
approximately 130 feet. Right-of-way will taper from 70 foot to 50
foot. A landscaped medium strip will be installed along this 130 foot
distance, with 18 foot pavement width each side of medium. Covenant
to be amended to include maintenance of strip. Will need County
approval and Plan Commission notice approval.
o Subdrains to lot 107, 108 and 100 needs to be six inches in size.
o Note riser locations on Development Plan.
o Add silt trap in open ditch at structure 602.
o Note open ditch; remove all obstructions and branch and trees from top
of bank to top of bank.
o Show drainage arrows on rear lots 118-126 and lots 103-105.
o Sod main swale between lots 126-123.

o Section 6 and 8 sewerage will go to off-site lift station in Section 7
and lift station will be dedicated to Clay Regional Sewer District.
o Indianapolis water proposed.
o Sewerage: Clay Regional Sewer District conditional approval on file.
Temporary, if required, will be per temporary building facility,
approved by Clay Regional Sewer District Board, and required State
offices.
o Need set of revised plans per above by 4:00 p.m. , January 29, 1987.
o TAC recommends approval per above comments being done and revised plan
being submmitted to DOCD.

Docket No. 5-87 S.P. , a Secondary Plat application for Springmill Streams,
Section Eight, consisting of 10 lots on 7.39 acres of land. Site is zoned
S-1 and is located on the East side of Clay Center Road, South of S. 131st
Street in Clay Township, IN.
PETITIONERS: Joe Sharp, Dave Sexton
o Check possibility of extending storm sewer to Elliot Creek on South
line of lot 200.
o Off-site drainage improvements to be built with Section 7; need plan
filed and approved witli this Section.
o Indicate riser locations on Development Plan.
o Subsurface drain along Clay Center Road needs to be six inches in
size.
o Need to show drainage arrows or note, side of lots 196 and 205.
o Show on erosion control plan sodding of rear yard swale, along lots
196 through 199.
o Easement along Clay Center Road needs to be indicated as a drainage
easement.
o Drainage easement along East side of lots 196 - 199 needs to be 15
feet in width.
TAC recommends approval per above comments being done and revised plans
being submitted to the Carmel DOCD.

Concept review of proposed Lincoln-Mercury and Oldsmobile dealerships in
Bauer Commercial Park. Project consists of a 39,550 sq. ft. building and a

27,600 sw. ft. building, both located on the Northeast corner of Lakeshore
Drive and 96th Street. Site is zoned B-3.
PETITIONERS PRESENT: Jim Nelson, Russ Dellen and Bob Hurst
o Concept presentation only for 14-acre auto dealership in Bauer
Commercial Park.
o Will require Board of Zoning Appeals B-3 review and approval.
o 14.32 acres in size.
o North side of 96th Street, Lakeshore Drive on West Bauer Drive, East
side of site.
o Area is within City of Carmel.
o Excluding 2.86 from current development; will need Special Use
approval at a future time.
o Two dealerships - Dellen Oldsmobile and Dellen Lincoln-Mercury.
o Area will drain to existing off-site Bauer Park retention/detention
facility to the North.
o Current ditch needs to be relocated/reconstructed per Kent Ward and
Tom Welch.
o Will have on-site detention of storm water in parking lot -- show
limits.
o Need dedicated easement for relocated ditch.
o Need City Carmel Board of Public Works approval of all curb cuts.
o Need Board of Public Works approval of Carmel sewers.
o Petitioner will upgrade landscaping.
o Review 96th right-of-way and pavement and drainage improvement with
Tom Welch, City Engineer. Needs 55 1/2 ft. right-of-way.
o Propose Indianapolis water.
o Fire hydrant locations approved by Carmel Fire Chief.
o In-ground pits proposed for mechanical equipment.
o Limestone, brick, glass buildings proposed.
o Lghting package proposed.
o Will need sign details.
o Final plans will be submitted at a later date.

Docket No. S 6-87 Special Use Exception for John Kirk Enterprises, 12345 N.
Meridian Street, Carmel, IN. Located in B-3 zoning. Petitioner seeks to
construct block building for storage of boats.
PETITIONERS PRESENT: Barb Conrad; Terry Brookie
o Proposed building will have no electricity, no heating, no plumbing,
one side partially open.
o Drainage plan was presented. Most of site drains into existing (1982)
wet retention/detention pond at rear of entire Kirk property complex.
Part of site drains to south of property line then to East and South.
All storm water eventually ends up in Carmel Technology Park drainage
system.
o TAC recommends drainage swale along South property line discharge into
on-site retention/detention facility. Also request 15 ft. drainage
easement along South property line, 10 feet along North and East
property line. Also recommend drainage easement around
retention/detention facility, 15 ft. from water's edge. Plans for
easements and drainage swale to be submitted to DOCD within 30 days.
Easement will be recorded within 30 days; swale will be constructed
with either construction of any building on the South parcel or by no
later than August 30, 1987.
o Well water is provided.
o Sewer is by on-site septic system.
o Status of accell/decel lane that serves road to the building.
o Parking for the building will be paved. Eight spaces proposed.
o Fire hydrant to serve this area is 700 feet North on Old Meridian.
o TAC recommends approval per comments above.

Docket No. V 1-87 Developmental Standards Variance for Larry Hamaker, 35
Twin Shore Court, Carmel, IN, located in an R-1 zone. Petitioner seeks
approval for automatic pool cover in lieu of fence.
PETITIONERS PRESENT: None.
o TAC recommends that six foot fence be installed per Ordinance
requirement for maximum protection of neighborhood residents and guests,
as it relates to a swimming pool.

Docket No. V3-87 Developmental Standards Variance for Charlotte Verbarg,
905 Bristol Road, Indianapolis, IN, located in an R-1 zone. Petitioner
seeks Variance from Section 7.2, Day Nursery, minimum area, one acre. Lot
size is 14,100 sq. ft. and Docket No. S 2-87 Special Use Exception.
PETITIONERS PRESENT: Charlotte Verbarg and John Vanags, builder.
o Petitioner will be requesting license from the Hamilton County Welfare
Dept. for a maximum of 10 full-time and five additional part-time
children.
o Drive will accomodate six full-size cars.
o Small sign that meets ordinance requirement is proposed.
o Water provied by an on-site well.
o Approximately 40% of house will be used for Day Nursery activities.
o Outside play facility will depend on age of children served.
o Rear yard is fenced with three-foot chain link fence on three sides;
pool is fenced on all sides.
o House is now on septic system; will connect to Clay Regional Sewer
District late summer 1987.
o Petitioner proposes to remodel existing two-car garage into family
room and add two-car garage to front of house.
o Recommend Variance and Special Use go with this owner only.
o No outside help is proposed initially.
o TAC recommends approval of technical aspects of project per
information submitted, ner ability of existing septic system to handle
additional load until house is hooked onto Clay Regional District
systems.

Docket No. V 4-87 Developmental Standards Variance for Osco Drugs (The
Centre), 1390 S. Range Line Road, Carmel, In, located in B-3 zoning.
Petitioner seeks Variance from Sign Ordinance, Section 25.7.04-1 b.ii:
number and type, for second sign; also, Section 25.7.04 1 b.ii: color and
design for interior illumination, orange letters. And, Docket No. S 5-87
Special Use Exception. Petitioner seeks to amend sign package in Unified
Center.

o Size of sign 4 ft x 19 ft. or 75 sq. ft. for both proposed signs.

approximately four feet higher than sign package sign allows.
o Sign meets construction and technical aspects of all ordinances in

Docket No. V 7-87 Two Developmental Standards Variances: (1) size of garage
exceeds the size allowed by Zoning Ordinance; (2) to locate the said garage
within a front yard of a residential lot. The lot is located at 1731 W.
106th Street, Clay Township, IN. Parcel is zoned S-1.
PETITIONERS PRESENT: Perry Meek, Owner; Marion Inman, Builder
o Proposed garage is to be 1008 sq. ft. ; allowed by Ordinance is 850 sq.
ft. Three doors proposed.
o Garage location allows proper side and front yard setback.
o Drainage for garage is acceptable.
o Garage will be connected to house via open, but covered breezeway.
o Garage is of wood siding, cedar roof.
o Drive to North is closed off now.
TAC recommends approval of technical aspects of project proposed.
