Dear Mr. Kiphart:
Pursuant to your January 8, 1987 correspondence and our
telephone conversation of January 9, this is to advise that
I have previously submitted three blueprints consisting of
the on-site - off-site drainage plan and a cross section of
the detention pond in the above-referenced matter. Patricia
Hollingsworth has advised me that I will need an additional
set of these drawings but they do not need to be filed by
the deadline set out at 12 :00 noon on Monday, January 12.
Regarding drainage, I also enclose two copies of calculations
regarding drainage on the property of John Kirk Enterprises
which have been provided by Weihe Engineering. Regarding
the detention pond, the work was performed by Frash Earth-
work of Noblesville, Indiana by invoice dated October 27,
1982. I have spoken with Bob Frash who stated that there
were no drawings for this. Pursuant to our conversation, I
have had Weihe Engineering prepare the cross section of the
detention pond pursuant to Mr. Frash' s representation that
the slope on this was 2 to 1 and the depth was 12 to 13 feet.
You indicated in our conversation that you would check the
records to find where the detention pond is set forth in the
minutes.

As we discussed, the drainage plans and detention ponds
will be submitted to Kent Ward on Monday, January 12. With
this correspondence, I am delivering two additional sets of
construction plans per your letter and I also enclose 10
copies reduced to 8 1/2" x 11" of the complete construction
plans for the Board members.
While I am awaiting a phone call from the State regarding
whether or not the existing handicap parking spaces meet
State handicap parking requirements, by this letter my
client is committing to meet the State requirements if the
present situation does not do so. The plans for this building
will show 8 paved parking spaces and regarding the acceleration/
deceleration lanes, as we discussed, I have called Mr. Tom
Welch and have not yet received a response. I will have
this information to you by January 16 as we discussed.
Regarding the fire hydrant, the nearest fire hydrant is
located within 1000 feet from the corner of my client' s
building going north on Old U. S. 31 towards new Carmel
Drive. I believe the correct figure is closer to 700 feet.
As this is strictly a storage building, this building
has no electrical, plumbing or H.V.A.C. In addition, this
building will not have any outside lighting. I also enclose
an aerial photo received from the Hamilton County Recorder' s
Office. Regarding the mobile home, this is to represent
that this will be removed from the premises on or before
June 1, 1987.
Mr. John Kirk will be unable to attend the January 26,
1987 meeting as he is currently out of the State of Indiana
and will not be returning until late March or early April of
1987. I will have a representative of John Kirk Enterprises
present at the January 26, 1987 meeting to answer questions
that the Board may have.
After reviewing the above, I ask that you contact me if
you have any questions.

Dear Mr. Kirk:
Upon staff review of the materials submitted for your Special Use Application,
we find the following items need attention.

all TAC members (list enclosed) by January 15, 1987.
The above matters will have to be resolved and completed revisions in the office
of the Department of Community Development by 12:00 o'clock noon, Monday, January
12, 1987 in order for this project to be placed on January agendas.
u/If the mobile home on the site was established in 1971 it is in violation of past
and present zoning ordinances.
Staff recommends Mr. Kirk's attendance at the January 26, 1987, Board of Zoning
Appeals Meeting.
