Please exercise caution and Do Not open attachments or click links from unknown senders or unexpected email. **** Board of Zoning Appeals, I am writing this letter in OPPOSITION to the variance being sought by Old Town Design Group on Lot 274 in the stableside area of Jackson’s Grant. Both code and the contract signed by all residents states in this area, a five foot side yard setback is the minimum for each residence. I have recently begun building on the street where Lot 274 is located and specifically questioned Old Town Design Group about the minimum side setback at my February 21 Homeowner Review. I was assured that this was code and the minimum side yard setback for all residences. I was shocked to find out that this ordinance had been violated, not 5 houses from my future residence. In short, Lot 274 has a side bump out, not on a foundation, that encroaches into the 5 foot side yard setback by over 2 feet. In addition, the bump out is for a fireplace. For all of the reasons below, this ordinance that states residences should be minimum of 10 feet apart, should be upheld: 1. Privacy of homeowners 2. Noise issues between homes 3. Fire safety 4. Lighting intrusion 5. Landscaping issues in such a small space 6. Resale value 7. Maintaining the appearance of our neighborhood Granting this variance is more than a single exception. It sets a precedent that will allow for additional violations of this minimum setback between homes. This is not a zero lot line neighborhood and granting this variance opens the door for a radical change to the vision for this beautiful community.
