Ordinance D-2455-19
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA,AMENDING ORDINANCE D-2436-18
AS AMENDED
Synopsis: Amends the 2019 salary ordinance to make it
consistent with the terms of the 2019-20 FOP and IAFF contracts.
WHEREAS, the Cannel Common Council passed Ordinance D-2436-18 on October 15,
2018, setting 2019 salaries for City employees, including Firefighters and Police Officers; and
WHEREAS, the International Association of Firefighters Local 4444 and the Fraternal
Order of Police Lodge #185 have each agreed to a two-year contract with the City that changes,
among other things, certain compensation to be paid in 2019; and
WHEREAS, it is necessary for the salary ordinance and these contracts to be consistent
in their terms.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. Ordinance D-2436-18, Section 1(b) is amended to read as follows:
1. POLICE
b. Accident Investigators and Certified Instructors shall, at the request of the Chief of Police, be
entitled to receive up to three dollars ($3.00) per hour for performing the duties associated with these
functions, in addition to all other forms of compensation.
Section 3. Ordinance D-2436-18, Section 1(d) is amended to read as follows:
d. Police Department employees who meet criteria specified by the Cannel Police Department Rules
and Regulations may qualify for the specialty pay specified below, in addition to all other forms of
compensation:

**Officers receiving Accident Investigator hourly pay are not eligible for this specialty
Each Police Department employee shall be entitled to receive only one (1) type of specialty pay at
any given time. The employee shall receive the highest specialty pay for which he or she is eligible. All
specialty pay shall cease when an employee no longer performs the duties associated with the pay or no
longer meets the qualifications for such pay, whether the change results from the decision/action of the
City or of the employee.
Section 4. Ordinance D-2436-18, Section 2, is amended to read as follows:

Section 5. Ordinance D-2436-18, Section 2(e), is amended to read as follows:

STATION CAPTAIN UP TO$1500.00 PER YEAR
Each Fire Department employee shall be entitled to receive only one (1)type of specialty pay at any
given time, except those receiving Public Information Officer, Special Duty, Station Captain or Master
Engineer specialty pay, who are eligible for one other form of specialty pay. The employee shall receive
the highest specialty pay for which he or she is eligible. All specialty pay shall cease when an employee
no longer performs the duties associated with the pay or no longer meets the qualifications for such pay,
whether the change results from the decision/action of the City or of the employee.
Section 6. Ordinance D-2436-18, Section 15(d) is amended to read as follows:
15. GENERAL PROVISIONS
d. Each full-time, part-time, seasonal or temporary employee who is required to report to work on a
declared holiday, whether on a scheduled or an unscheduled basis, shall receive fifteen dollars ($15.00)
per hour premium pay for each hour actually worked on the holiday. Such premium pay shall be
calculated to the nearest quarter hour.
Section 7. The remaining provisions of Ordinance D-2436-18, as amended, shall
remain in full force and effect and are not affected by this Ordinance.
Section 8. All prior City ordinances or parts thereof that are inconsistent with any
provision of this Ordinance are hereby repealed as of the effective date of this Ordinance.
Section 9. If any portion of this Ordinance is for any reason declared unconstitutional,
invalid or unenforceable by a court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance.
Section 10. This Ordinance shall be in full force and effect from and after January 1,
2019.
