After consulting with the BZA legal counsel, the answers to your questions are listed below:
a. I don’t see a problem with them washing the truck at their residence occasionally, so long as this doesn’t grow
into an excuse for them to continue parking the truck there overnight. (Washing it every afternoon and then letting it sit
there overnight to dry isn’t complying with the UDO and the BZA’s decision.)
b. I don’t understand what deliveries he may be picking up at the residence. It seems to me that deliveries for a
business should go to the business’ address, not a home address. (Again, if this becomes an excuse for the truck to be
parked there for lengthy periods every day, then this use is out of compliance with the UDO and the BZA’s decision.
(However, occasional, brief pick-ups of deliveries could possibly be okay.)
c. Each day the UDO is violated constitutes a separate violation, and the maximum penalties are –
1. First violation, $1,000.
2. Second violation, $2,000.
3. Third violation, $3,000.
4. Fourth violation, $4,000.
5. Fifth and later violations, $5,000. (These are all per day of violation.)
The BZA duly decided not to give them a variance to continue to park a large commercial truck in their driveway. They
did not appeal this decision to the court. The City will request that the City Court judge impose the maximum penalties if
they continue to violate the ordinance.

Hi, John -
The Thornes sent us this email with questions, regarding using their commercial truck at 12022 Pebble Brook Ln. I think
they will be storing it off site, though. I assume they would be okay to bring the truck to their house site and quickly
wash it, as well as drop off deliveries with it. But what about the number of hours for parking the truck there, overnight,
short term? Would we even allow that, or does that get into a gray area?

The only variance I could think of that would be remotely similar to a commercial vehicle variance is this Appeal of a building
permit for a carport that was going to house a commercial trailer.
