HomeMy WebLinkAboutD-2459-19 Amends Document Fee Schedule SPONSOR(S): Councilors Campbell, Carter, Finkam, Rider, and Worrell ORDINANCE NO.D-2459-19 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,INDIANA, AMENDING CHAPTER 2,ARTICLE 5,SECTION 2-179 OF THE CARMEL CITY CODE Synopsis: Amends the City document fee schedule to ensure it conforms with the Indiana Code. WHEREAS, the Common Council has established a fee schedule for the certification, copying and, transmission of City documents; and WHEREAS, the fee schedule should be clarified to ensure that the fees charged conform with Indiana Law. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, that: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Chapter 2, Article 5, Section 2-179(a) of the Carmel City Code is hereby amended to read as follows: "(a) Each Department of the City shall charge the following fees, which fees shall not exceed the fees allowed by Indiana state law. 1) Copying of accident Reports $5 per report 2) Other copies $.10(B&W); $.25 (Color) 3) Photo(4 x 6 or 3 x 5 color) The greater of$1 per photo or actual copying cost 4) Video Cassette Copies The greater of$10 or actual copying cost 5) Cassette Tape Copies The greater of$5 or actual copying cost 6) Duplicate of a computer tape, "Direct cost,"as defined by Indiana Code Section 5-14-3- computer disk, microfilm, law 2(d), as the same may be amended from time to time, of enforcement recording, or similar supplying the information in that form, not to exceed$150 analogous record system for a copy of a law enforcement recording 7) Enhanced access Reasonable fee 8) Electronic maps Reasonable fee 9) Document Certification $5 per record Ordinance D-2459-19 Page One of Three This Ordinance was prepared by Benjamin J.Legge,Assistant Corporation Counsel,on 3/20/19 at 11:28 a.m. No subsequent revision to this Ordinance has been reviewed by Mr.Legge for legal sufficiency or otherwise. The remaining provisions of Carmel City Code Section 2-179 are not affected by this Ordinance and shall remain in full force and effect. Section 4. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 5. If any portion of this Ordinance is-for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6.
