He agreed with me that if the lot coverage percent changes,you would need to re-notice your request for the BZA.You could not appear at the meeting on Monday night with a change in the lot coverage calculation and overall plan. If the percent is changed,the next BZA meeting you could attend is September 24. Public notice would be due by Sept. 14,which means it would be due to the Current in Carmel early morning on Sept.4. Please confirm if this is your new plan, so that we can update the agenda accordingly to show your item as tabled. A desired feature of a pergola from Smart Pergola is the ability to close vanes in the upper Section during inclement weather.The vanes rotate 90°, open to closed, when a sensor senses excess moisture in the air.The restaurant patrons remain dry. Another benefit, from the Owner's point of view, is the ability to use concrete for the floor.This design increases the impervious coverage of the lot (Calculations are shown on the attached drawing). During an impromptu meeting Thursday afternoon August 23rd, with John Thomas, Storm Water Administrator for the City of Carmel Department of Engineering; Ken Keltner, Owner; and Jim Streeter, Owner's Representative attending. A "Gentlemen's Agreement" was agreed to by all; Re: Controlling the storm water shed from the lot; i.e., Water Garden. During an earlier meeting, the same afternoon, between you, Ken Keltner, and myself,the requirement for bicycle parking being located just East of the pergola was discussed. You suggested a solution where 2 bicycle parking spaces remain just East of the pergola with the remaining spaces being located just West of the 8' x 12" room addition North of the house. It was agreed by all that your suggested solution be adopted. This solution increases the pervious area and allows the area to be used as a "Water Garden". This Agreement works well with the "Gentlemen's Agreement" noted in the paragraph above. Most of the area, net about 475 Sf, will be green space with Water Garden(s), including Junipers, prairie grass, and prairie flowers. Respectively, we request to be allowed to be present at this evening's BZA Hearing before the Hearing Officer. We are already on the Docket. And an Agreement has been reached that mitigates the additional lot coverage caused by the Smart Pergola. I have checked with John Molitor, Attorney for the BZA, to see if you could proceed tonight at the BZA meeting. Regarding the lot coverage variance,John advised against proceeding tonight, because the change in noticed/requested lot coverage is greater than 1%. You may still come to the hearing tonight for the parking variance, but we will have to Table your lot coverage variance to the next month.
