Project Shown: Preserve at Fall Creek — 82nd & Fall Creek
Purpose: Representations to the committee members of a similar project where
Pulte Homes has consciously worked with the contour of the existing
topography to preserve the character of the property and protect the
existing trees. Enclosed are photos of this project that indicate walk-
out basements, retaining walls in the front, sides and rear of the
homes and streets that follow the existing grades.

COMMITMENTS CONCERTING THE USE
AND DEVELOPMENT OF REAL ESTATE
Re: Eagle Ridge—Paul E. Shoopman(owner)

Statement of Commitments:
Owner commits that at the commencement of development of the subdivision, (A) 116th
Street and 121st Street will be widened and resurfaced from the eastern property line to
the county line. (The resurface will be according to present county standards, and will
consist of a 900 ton/mile wedge and level course,2 inches #9 binder, 1 inch#11 surface
and a 3 foot stone shoulder 6 inches deep on both sides of the road), and(B) 116th Street
immediately east of the county line will be reconstructed to eliminate the hump in the
road by lowering the pavement a maximum of 3 feet and adjusting the side slope and
swales in line with the plan/profile sheet. (not attached)
Binding on Successors and Assigns. These commitments are binding on the owner of the
real estate, each subsequent owner of the real estate, and each other person acquiring an
interest in the real estate, unless modified or terminated by the commission. These
commitments may be modified or terminated only by a decision of the commission made
at a public hearing after notice as provided by the rules of the commission.
Effective Date. The commitments contained herein shall be effective upon the approval
of the applications filed with the commission under Docket No. 27-97 P.P.
