Indianapolis, IN 46250 PP Long Branch Estates 108 Dear Mr. Kelly: Steve Cash, Sean Degen, Ken Brasseur and I met to discuss this project. The proposed plan provides significant green space in environmentally sensitive areas. However, I think the plan could be better. I realize that you're designing a project with a variety of parameters and my suggestions may not be possible. The following thoughts may help improve the plan. I would first delineate the major swales and protect them with drainage easements. You have missed the natural topography in several locations- like between lots 8 and 9. These natural valleys with a dry darn could provide storm waterdetention. By utilizing the natural topography for the basins less earth is moved, more infiltration occurs and the CN goes down. Is it possible to eliminate detention pond #5? Could the time of concentration be increased by lengthen the flow path and/or lower the CN value for the watershed? Pond #5 adds significant "hard surface" to the hydraulic characteristics and increases the CN value. I think pond #6 could also be eliminated by utilizing the natural valley in the wooded area. You may need to calculate the impact to the woods but I believe the overall plan would be better. I believe reducing hard surface and promoting infiltration has positive effects on the outlet stream and ground water. Reducing the amount of mass grading, soil compaction and excavation helps to meet these goals. I've rambled enough but I would be glad to discuss this project in greater detail. Please provide the signed form to make the storm sewers regulated. One is needed for each section. 2, Provide the signed Non-enforcement Permit form with the appropriate check.One is needed for each section. 3. Please forward an engineers estimate or copy of the contract for 100%of the construction costs for storm sewers(including SSD),erosion control,and monuments and markers. 4. Submit original letters of credit or bonds for the above amounts. Plans,Calcs and Secondary Plat: Construction Plans- 5. Pipe size, length,slope and approved type of material used. 6. Show the drainage easement line on lot 98. 7. Some house pads are shown encroaching on the DE. Please adjust the house pads. 8- The offsite DE for the pipe extending from Detention Basin#8(str.700—702)needs to be 30' in total width. 9. Please label the street widths. 10. Some pads for Iots in future construction area north of detention basin#3 are below the 100 year elevation. 11. The easement around pond must be 15'from top of bank. See lots 26,27,28&75. 12. PIease show emergency overflow routes with spot elevations for the detention areas. 13. Extend outlet pipes all the way to the creek.(Sheet C202• Str 726). 14. Downstream improvements are needed in a few areas. (Sheet C204—Str,781:Det.Basin 6 and Str. 757: Det.Basin 1). Where the pipes discharge onto existing cover there will be continual wetness followed by erosion problems. These areas of concern are offsite areas and in Common Area F. Please analyze the slope and velocity vs.the ground cover. Additional measures will be required to ensure that long term problems will not exist. An onsite meeting with the Inspector may the best method for evaluating these areas. 15. For swales with less than 1%slope,the allowable SSD material is 6"double wall,smooth wall SSD. 1 MAY 02 '01 08.40AM P.2/3 16. Please show the approximate SSD stub locations to each lot. Some stubs are shown and others are not. 17. Corresponding to the previous comment,SSDs outletting into pond or creek must be installed with a section of CMP with animal guard installed as you have show elsewhere on the plans. 18. Show the creek 100 year elevation. 19. Please note the adjacent landowners on the plans. 20. Plans are to be stamped"Approval Pending-Not For Construction." 21. At outlets into the creek,show rip-rap placed at the outlet on both sides of the creek,but not in the flowline. 22. Please ad a note stating that all debris and obstructions will be removed from top of bank to top of bank along the creek or open drain. Final determination of clearing to be made in the field by the Inspector. 23. The landscaping plan conflicts with the drainage plan. It does not appear that the landscaping was designed with the drainage layout in mind. Erosion Control Plan- (Show the following). 24. Revise the erosion control plan per any of the previous, applicable comments. Storm Sewer Plan&Profile Sheets- 25. Show a plan and profile of pipe run 726-Creek and 711 -Ex.Culvert. 26. Label the type of material used(RCP). 27. Please show the locations of other utilities. 28. Please add notation on the open ended inlets for debris guards to be installed. 29. Include notation for debris guards to be installed at pond outfall pipes. 30. The topo is incorrect between Str.702-703 on sheet C701. 31. Install a beehive on Str. 710 if grades will allow. 32. It appears from the profile that beehive structures will be used and not end sections. If this in the case, please show the symbol for beehives on Str.725,737,732(This line could be lowered 6"), 783 &782. Detail Sheets - Show the following approved Hamilton County details where applicable. Copies of the Approved Hamilton County details are enclosed. 33. Swale cross-section. (#94-18) 34. These plans reflect changes discussed with Mr. Degen and Rich Kelly of Paul I. Cripe, Inc, including 25 foot conservation easements along the back side of lots bordering woodlands that are to be preserved. These easements should be reflected in homeowner covenants for the subdivision, not allowing construction in these protected areas. I have received and reviewed the Conservation Area Survey by J.F. New & Associates dated August 28, 2000. The report appears very detailed and accurate. The current open space plan preserves the vast majority of primary conservation areas and provides nature corridors throughout the development. I have received a revised landscape plan for the development and it is acceptable. Exact species and landscaping of the designed storm water retention ponds (a requirement of the open space ordinance) will be addressed in later phases of the development(secondary plat approval). Mr. Degen has stated on several occasions that the character of the property is very important to the development. He does not plan to cut and grade every home site flat, but set individual homes in the terrain disturbing as little as possible. Per the Inspector's requirements, the stump is to be treated with a growth inhibitor. Because of the nature of the specific site,the standard requirement for clearing along both top of banks (detail #95-7)will not be required. Instead, clearing requirements in detail #95-6 will he allowed. Per the meeting, the clearing on the top of bank will take place along the north side of the creek, The purpose of this requirement is to provide an operational side for the clearing within the drain and to provide an area for access for future maintenance of the drain. Per the Inspector, desirable species 8"or more in diameter may remain. Actual trees to remain will be determined by the Inspector during construction. Other dead, fallen or severely leaning trees that pose a threat to becoming an obstruction to the creek should also be removed. Those of us who did attend were unaware of this proposed development adjacent to our homes and knew nothing before nor much after this meeting. We have concerns regarding 1) water drainage and how it affects our property 2) the proposed grading and how this will change the character of the land 3) the large old woods and how this will be disturbed 4)the removal of trees along fence lines 5) types of pipelines and locations 6) traffic studies on 121st St., 116th St. And Shelbourne - Michigan Rd. Planned enlargements and how that will affect the flow of traffic 7)proposed density seems not to conform to what we understand as low density in West Clay Township 8) wetland studies and wetland birds nesting in the area 9) unclear locations of entrances and exits from development 10)type of lighting and location of development lighting 11) proposed new extension of Shelbourne Rd. -who will maintain the landscaping on either side and what type of landscaping is visioned. We'd like to hear about Scott Brewster's report on the tree situation and traffic engineers need to seriously look at traffic flow and safety in this entire area which this development will affect including Boone County. We'd like to request postponing the upcoming Sept. 5Th meeting until ALL neighbors have been notified so they will be able to be informed and use their right to speak up. Street , our property is to the immediate west of the above planned subdivision , Long Branch Estates . We moved into this area 21 years ago to get away from subdivisions , noise , traffic , now all of this is being thrown into our back yards . . . There are many issues concerning this proposed development , with traffic being at the top of the list . With the impending development to the west of us by Dura Builders consisting of 285 homes and the development of Long Branch Estates of 150 homes . . . , this could add as many as 800 more cars per day on the already overloaded two lane West 116th . street , not counting school buses , delivery trucks , etc . As you are aware , there is a steep hill just to the west of Shelborne Road where many accidents have occurred over the years , I have seen cars passing over the hill . . . With an entrance to the proposed Long Branch Estates subdivision , facing West 116th . street , this will surely create more havoc with an already overloaded street . WEST bound traffic on 116th . feeds into North Michigan Road , south and north bound . traffic is tied up for miles at peak times already . . . we are aware that Michigan Road will undergo a major improvement in a few years , however, development is underway for most of Michigan Road corridor from 106th . street to 96th . . creating even more traffic . . While we realize progress cannot be eliminated in our area , there has to be some control to growth . . Safety of residents should be top , Lority . . . . Another issue is our w,ildli e we have many types of wildlife along West 116th. . . what happens to their homes when the bulldoziers arrive . . . Drainage has always been a problem with the property being developed for Long Branch Estates . . The property is rolling with creeks in many areas of the property . . . . Long Branch Creek can only hold so much water . Pulte homes has never contacted us regarding any issues we may have . . Common courtesy should always be a factor when a Developer is considering a project where adjoining properties are concerned . However several excavated ponds are shown that will require deposition of waste soil. How and where will the spoil be spread or used? There are advantages to the future homeowners and community if the existing soils are not disturbed. Increased infiltration,reduced storm water runoff, more consistent flow in Long Branch Creek and better water quality are some benefits if the soil is not compacted and degraded by cut and fills. My recommendation is to leave the rolling lots and common areas undisturbed and waste the spoil in berms or other concentrated uses. • The plan could provide more information about drainage along the county roads, and rear swales. Along Shelborne Road, from the intersection to a point 500.0'to the north, the right of way is required to be a 75' half. A triangular cut is also needed at the intersection, the cut should consist of two 50.0' legs. 7. The decel lane along 116th Street will need to be 150.0' in length and 12.0' in width. The taper will need to be 100.0' long. 8. The pavement cross section for 116th Street consist of the following: 14" stone base, 5" intermediate course of pavement and 1" surface course. Along Shelborne Road, the cross section consist of the following: 12" stone base, 4" intermediate course of pavement and 1" surface course. 9. The following covenants and restrictions are to be included in the Secondary Plat of Long Branch Estates: Square Footage Minimums: The following areas do not include closed or enclosed porches, attics, finished or unfinished basements which are more than three feet below the surrounding grade, garages, or other unheated areas which are not intended for living area all year. The Architectural Review Committee shall determine from the plans if a particular area is to be included in the area of the house for purposes of this restriction: Single-story house: 1,800 s.f. One and one-half story house: First Floor 1,400 s.f. Second Floor 500 s.f. Total of both floors 1,900 s.f. Two-story house: First Floor 1,200 s.f. Second Floor 1,100 s.f. Total of both floors 2,300 s.f. Exterior Construction: All exterior materials on the house and garage must be a material other than aluminum or vinyl, except for windows. The front and sides of the home on the first floor must be substantially brick unless common building conventions prohibit its use. No aluminum or vinyl siding or soffits and no asphaltic siding of any kind shall be permitted. All masonry shall be mortared. All chimneys shall be clad on all four sides with brick or stone unless it protrudes from the interior of the home. All side and rear yards shall be hydro-seeded, or may be sodded with permission of the Architectural Review Committee, but no part of the yard may be planted with the assistance of straw or other non-grass material. Declarant shall maintain all streets and curbs in good condition satisfactory for the purpose for which they were constructed until they have been accepted by the public. (b) Landscaping. All landscaping within the street rights-of-way is subject to the approval of the appropriate governmental authority. Each Owner shall cut all grass and trim all other landscaping in the rights-of-way adjoining his Lot lines and shall maintain all sidewalks in the rights-of-way nearest his Lot lines. Each Owner shall immediately replace any street trees and lighting required by this Declaration, the Plat, or any other document controlling maintenance of Lots. 3. The following covenants relating to the design of housing in Long Branch Estates, in addition to those found in the Plat, are to be found in the Declaration of Covenants and Restrictions of Long Branch Estates: Construction of Residences: (a) Land Use. Lots may be used only for single-family residential purposes and only one Residence not to exceed the maximum height permitted by and measured pursuant to the Zoning Ordinance of the City of Carmel, Indiana may be constructed thereon. No portion of any Lot may be sold or subdivided such that there will be thereby a greater number of Residences in Long Branch Estates than the number of Lots depicted on the Plat. Declarant hereby grants, reserves and creates a "Conservation Easement"over the rear twenty-five (25)feet of certain Lots in the Subdivision, as shown on the Plat. Except as specifically provided herein, the Conservation Easement shall be restricted from any development, or any use other than as natural fields,forest lands, landscaped areas approved by the Architectural Control Committee and as a sanctuary for wildlife and wild plants and passive recreation. Actions prohibited in the Conservation Easement include, but are not limited to the following. (a) the construction or maintenance on the Conservation Easement of any buildings, structures or other improvements, other than fencing or as otherwise expressly permitted herein; (b) the dumping or other disposal of trash, garbage, or other refuse of any nature whatsoever on the Conservation Easement; (c) the cutting or clearing of timber or trees, earth moving or grading, intentional burning, or filling, except as determined necessary by the Architectural Control Committee to control or prevent imminent hazard, disease or fire; and (d) the construction,maintenance, or erection of any sign or billboard on the Conservation Easement, except for the posting of"No Trespassing" signs. 2. Declarant hereby reserves the right to install erosion control structures or devices in the Conservation Easement, and to enter onto the Conservation Easement to remove dead, dying or diseased trees, or to prevent imminent hazard or fire. 3. The Association shall enforce the provisions of this Section . Such enforcement rights shall include the right to enter onto the Conservation Easement in order to monitor compliance with and enforce the terms of this Section, including the right to repair any damage to the Conservation Easement. Any Owner that violates the provisions of this Section shall reimburse the Association for the cost incurred by the Association (I) to enforce the provisions of this Section, including reasonable attorney fees, and (ii) to repair of any damage to the Conservation Easement, including the replacement of any destroyed or damaged trees or vegetation. Such amount shall be a lien on the violating Owner's Lot, which may be foreclosed by the Association in the same manner as delinquent dues provided herein. 4. Nothwithstanding anything herein to the contrary, the provisions of this Subsection (b) Conservation Easements shall not be amended except by the written approval of one hundred percent (100%) of the Owners of all Lots in Long Branch Estates. (c) Sizes of Residences. Except as otherwise provided herein, no Residence may be constructed on any Lot unless such Residence, exclusive of enclosed or open porches, attics, garages, finished or unfinished basements which are more than three feet below the surrounding grade, or other unheated areas which are not intended for living area all year, shall contain the following minimum living areas, as deteimined by the Architectural Review Committee: 3 Single-story house: 1,800 s.f. One and one-half story house: First Floor 1,400 s.f. (the master bedroom is on the Second Floor 500 s.f. first floor): Total of both floors 1,900 s.f. Two-story house: First Floor 1,200 s.f. Second Floor 1,100 s.f. Total of both floors 2,300 s.f. (d) Temporary Structures. No trailer, shack, tent, boat,basement, garage or other outbuilding may be used at any time as a dwelling, temporary, or permanent, nor may any structure of a temporary character be used as a dwelling. (e) Driveways. All driveways in Longbranch shall be concrete in material. (f) Fireplace Chase. All fireplace chases and flues shall be of masonry veneer or material which is equal to or better than masonry veneer in quality and appearance. No fireplace chase shall be constructed of stucco board, wood siding, or similar materials unless protruding from the interior of the home. (g) Storage Tanks. All above or below ground storage tanks, with the exception of gas storage tanks used solely in connection with gas grills for the purpose of grilling or cooking food, shall be and hereby are prohibited. (h) Construction and Landscaping: Time Requirements: Divestiture: Penalties. All construction upon, landscaping of, and other improvements to a Lot shall be completed strictly in accordance with the Lot Development Plan approved by the Architectural Review Committee. All landscaping specified on the landscaping plan approved by the Architectural Review Committee shall be installed on the Lot strictly in accordance with such approved plan within thirty(30) days following substantial completion of the Residence unless delayed due to adverse weather conditions but in no event shall it be installed later than June 30th of the year. (i) Mailboxes. All mailboxes installed upon Lots shall be uniform in type and color. Such mailboxes shall be installed upon posts approved as to type, size, and location by the Declarant and the United States Post Office. Replacement of mailboxes shall be subject to the prior written approval of the Architectural Review Committee and shall be as nearly as reasonably possible identical to the original mailboxes and posts required by Declarant. (j) Septic Systems. No septic tank, absorption field, or any other on-site sewage disposal system(other than a lateral main connected to a sanitary sewage collection system operated by the Clay Township Regional West District or a successor public agency or public utility) shall be installed or maintained on any Lot. (k) Water Systems. Each Owner shall connect to the water main maintained by a private or public water utility to provide water for domestic use on the Lot and shall pay all connection, availability, or other charges lawfully established with respect to connections thereto. (1) Drainage. In the event storm water drainage from any Lot or Lots flows across another Lot, provision shall be made by the Owner of such downstream Lot to permit such drainage to continue, without restriction or reduction, across the downstream Lot and into the natural 4 drainage channel or course, although no specific drainage easement for such flow of water is provided on the Plat. To the extent not maintained by the Drainage Board, "Drainage Easements"reserved as drainage swales shall be maintained by the Owner of the Lot upon which such easements are located such that water from any adjacent Lot shall have adequate drainage along such swale. Lots within Long Branch Estates may be included in a legal drain established by the Drainage Board. In such event, each lot in Long Branch Estates will be subject to assessment by the Drainage Board for the costs of maintenance of the portion of the Drainage System and the Lake Control Structures included in such legal drain, which assessment will be a lien against the Lot. The elevation of a Lot shall not be changed so as to materially affect the surface elevation or grade of surrounding Lots. Perimeter foundation drains and sump pump drains, shall be connected whenever feasible into a subsurface drainage title. Down spouts and drains shall be designed to disperse runoff for overland flow to street or swale collection systems. Each Owner shall maintain the subsurface drains and tiles located on his Lot and shall be liable for the cost of all repairs thereto or replacements thereof. (m)Sheds. Outbuildings and sheds are specifically prohibited. Maintenance of Lots. (a) Vehicle Parking. No camper, motor home, truck, trailer, boat or disabled vehicle may be parked or stored overnight or longer on any Lot in open public view. (b) Signs. Except for such signs as Declarant may in its absolute discretion display in connection with the identification of development of Long Branch Estates and the sale of Lots therein,no sign of any kind shall be displayed to the public view of any Lot except that one(1) sign of not more than four(4) square feet may be displayed at any time for the purpose of advertising the property for sale, or may be displayed by a builder to advertise the property during construction and sale. (c) Fencing. No fence, wall, hedge, or shrub planting higher than eighteen (18) inches shall be permitted between the front property line and the front building set back line except where such planting is part of Residence landscaping approved by the Architectural Review Committee and the prime root thereof is within six(6) feet of the Residence. Corner Lots shall be deemed to have two (2)front property lines. Trees shall not be deemed "shrubs" unless planted in such a manner as to constitute a"hedge". All fencing shall be wrought iron in appearance, and the Architectural Review Committee may not approve a fence which either is not wrought iron or does not have a wrought iron appearance. All fencing on a Lot shall be uniform in height, style, and color and substantially similar in material. No fence shall be erected or maintained on or within any Landscaping Easement except such as may be installed by Declarant and subsequently replaced by the Association in such manner as to preserve the uniformity of such fence. No fence may be erected on a Lot without prior approval of the Architectural Review Committee, which shall approve or disapprove the location of all fences;provided, however, that all fencing erected on a Lot must be erected either(I) within three(3)inches of the property line of such Lot, or(ii)more than ten (10) feet from the property line of such Lot. Owners of Lots adjoining Lots on which a fence is erected within three(3) inches of the property line shall have the right to connect a fence to the fence on the adjoining Lot if the new fence satisfies all of the criteria expressed herein and is approved by the Architectural Review Committee. The Architectural Review Committee may establish further restrictions with respect to fences, including limitations on (or prohibition of) the installation of fences in the rear yard of a Lot abutting a Lake and 5 design standards for fences. All fences shall be kept in good repair. No fence, wall, hedge, or shrub planting, or tree foliage which obstructs sight lines at elevations between two (2) and six (6) feet above the street shall be placed or permitted to remain on any corner Lot within the triangular area formed by the Lot lines at the streets and a line connecting points 25 feet from the intersection of said street Lot lines; and, the same rule shall apply to the intersection of a driveway with a street, in which case the edge of the driveway pavement shall be substituted for one of the street Lot lines. (d) Nuisances. No noxious or offensive activity shall be carried on upon any Lot nor shall anything be done thereon which may be, or may become, an annoyance or nuisance to the neighborhood. Violation of any ordinance governing noise, building or lot maintenance, or any other public nuisance shall be deemed to be a nuisance creating rights in every affected Owner, the Declarant, and/or the Association, as the case may be, to enforce the provisions hereof against the offending Owner. Barking dogs shall constitute a nuisance. In the event of successful enforcement by an Owner, the Declarant, or an Owner of the provisions thereof, the offending Owner shall be liable to the prevailing party for attorneys' fees, court costs, and all other costs and expenses of litigation and collection in connection therewith. (e) Garbage and Refuse Disposal. No Lot shall be used or maintained as a dumping ground for trash. Rubbish, garbage or other waste shall be kept in sanitary containers out of public view except not more than 24 hours prior to its removal thereof, when it may be placed at the curb of the Lot. All equipment for storage or disposal of such materials shall be kept clean and sanitary. (f) Livestock and Poultry. No animals,livestock or poultry of any kindrshall be raised, bred or kept on any Lot, except that dogs, cats or other household pets may be kept provided that they are not kept,bred, or maintained for any commercial purpose. The owners of such permitted pets shall confine them to their respective Lots such that they will not be a nuisance. Owners of dogs shall so control or confine them so as to avoid barking which will annoy or disturb adjoining Owners. Unless permitted by the Board of Directors of the - Association,no Owner shall maintain more than two (2) of the same type(dog, cat, bird) of pet nor more than four(4)total pets;provided, however, that fish which are located in indoor aquariums and which pose no risk to the public health shall not be considered pets for the purpose of this restriction. No dangerous or potentially dangerous pets, such as exotic animals (large wild cats, wolves, alligators, snakes which are poisonous or longer than two feet, poisonous spiders, etc.) shall be permitted to exist in a Residence or on a Lot without the unanimous consent of the Architectural Review Committee and the Board of Directors; provided, however, that the decision of the Board of Directors to permit such animal or animals may be overturned by a majority vote of the Members at any meeting. (g) Outside Burning. No trash, leaves, or other materials shall be burned upon a Lot unless the smoke therefrom would not blow upon any other Lot. Owners shall use appropriate incinerators and shall at all times be in compliance with all applicable legal requirements for outside burning. (h) Antennas and Receivers. No antenna, satellite dish, or other device for the transmission or reception of radio, television, or satellite signals or any other form of electromagnetic radiation shall be erected, used or maintained outdoors and above ground, whether attached to a building or otherwise, on any part of the Property, including Lots, without the written approval of the Architectural Review Committee, which approval shall not be unreasonably withheld;provided, however, that any such device may be installed and maintained on any 6 Lot without the necessity of such written approval if: (a) it is not visible from the neighboring Lots, streets or Common Area; or(b)the Owner, prior to installation, has received the written consent of the Owners of all Lots who would have views of the device their Lots; or(c) the device is virtually indistinguishable from structures, devices, or improvements, such as heat pumps, air-conditioning units, barbecue grills,patio furniture, and garden equipment, which are not prohibited by these convents or Bylaws, or(d) it is a satellite dish two (2) feet or less in diameter and not affixed to the roof of a residence; or(e) if prohibition of the installation, use, and maintenance of such device is specifically preempted and superseded by applicable governmental authority. (i) Exterior Lights. No exterior lights shall be erected or maintained between the building line and rear lot line so as to shine or reflect directly upon another Lot. (j) Electric Bug Killers. Electric Bug Killers, "zappers", and other similar devices shall not be installed at a location or locations which result in the operation thereof becoming a nuisance or annoyance to other Owners, and shall be operated only when outside activities require the use thereof and not continuously. (k) Tennis Courts. No tennis court shall be installed or maintained on any Lot without prior written approval from the Declarant or the Architectural Review Committee. (1) Swimming Pools. No swimming pool or equipment or building related thereto shall be constructed without the prior approval of the Architectural Review Committee. The Architectural Review Committee may require, as a condition to the location of a swimming pool on a Lot, that the Owner install a mechanical pool cover. If the Board imposes such requirement, then a mechanical pool cover of a type and manufacture approved by the Architectural Review Committee shall be installed by the Owner in compliance with all applicable governmental requirements and all requirements established by the Architectural Review Committee. (m)Vacant Lots. It shall be the duty and obligation of the Owner of a vacant Lot to maintain such Lot and mow the lawn thereof. Declarant and the Association shall have the right,but not the duty, to enter upon each vacant Lot and to maintain the appearance thereof by cutting weeds, mowing grass, trimming trees,removing debris,installing erosion control devices, and performing any other act reasonable under the circumstances. The Owner shall be responsible for payment of all such expenses upon demand and the Declarant or the Association, as the case may be, shall have a lien on such Lot for the payment of such expenses, together with attorneys' fees and all other costs and expenses of litigation and collection which may be incurred in connection therewith. A summary of these revisions follows: 1. The Landscape Plan has been revised to incorporate the comments of Mr. Scott Brewer as were identified during a meeting held at the site on June 30, 2000, and follow-up phone conversations thereafter. 2. The layout in the central area of the development adjacent to Pond#2 has been modified to maintain the desired density while accommodating the right-of-way for the realignment of Shelborne Road. 3. A 10-foot wide multi-use path has been added along 116th Street. An 8-foot wide multi-use path has been added along Shelborne Road and along 121st Street. 4. Revisions to the layout of the water lines have been made per phone conversations with the water company. 5. The stub street to the west property line (Peregrine Falcon Drive) has been omitted. However, the right-of-way remains on the plat. The developer proposes to construct the street when the connecting street within Eagle Ridge is constructed. A benefit of this proposal is that the trees within the floodplain of Long Branch will not need to be cleared until the street is constructed. We trust that the responses outlined herein adequately address the written and verbal comments of the various reviewing agencies. A summary of these revisions follows: 1. The Landscape Plan has been revised to incorporate the comments of Mr. Scott Brewer as were identified during a meeting held at the site on June 30, 2000, and follow-up phone conversations thereafter. 2. The layout in the central area of the development adjacent to Pond #2 has been modified to maintain the desired density while accommodating the right-of-way for the realignment of Shelborne Road. 3. A 10-foot wide multi-use path has been added along 116th Street. An 8-foot wide multi-use path has been added along Shelborne Road and along 121St Street. 4. Revisions to the layout of the water lines have been made per phone conversations with the water company. 5. The stub street to the west property line(Peregrine Falcon Drive) has been omitted. However, the right-of-way remains on the plat. The developer proposes to construct the street when the connecting street within Eagle Ridge is constructed. A benefit of this proposal is that the trees within the floodplain of Long Branch will not need to be cleared until the street is constructed.
