Public Hearings
(V) Prokai Pool Setback.
The applicant seeks the following development standards variance approval:
1. Docket No. 19020004 V UDO Section 5.02.C.7 Minimum swimming pool setbacks of 10' (or
easement plus 3') required, 10' into easement requested. The site is located at 3852 Branch Creek
Ct., at Long Branch Estates, Section 3, Lot 143. It is zoned S1/Residence-ROSO II Q. Filed by Bill
Lambert of Perma Pools, on behalf of Stephen Prokai, owner.
Petitioner: Stephen Prokai
• There's a deck and landscaping in the rear of the house that is not within the easement
• We would have to remove some pavers and bushes to have the pool installed
• We would like to encroach 10' in the existing 25' easement
• We contacted our HOA to fill out the proper forms and provided them with the plans
• Long Branch Estates HOA provided their letter of approval
• We submitted a Consent to Encroach form to the City Engineering Department
• We received email confirmation from Jarrod Huff of City Engineering that we were granted the consent
to encroach. I can forward Staff this email confirmation from the Engineering Department
• We have submitted letters of approval from our neighbors

Department Report: Angie Conn
• The conservation easement was part of the original Residential Open Space Ordinance (ROSO)
• Today,this easement is mostly a grassy area with two trees
• We ask the property owner to preserve the existing trees in the easement
• The City Forester has approved the site plan
• The City Engineering Department did want the consent to encroach approval and has been granted
• We recommendation positive consideration of the variance request

• Does the conversation easement runs at both ends of the property? Stephen Prokai: Refers to the plot
plan-yes,the easement runs along the property line and the 100 year flood zone.
• It looks like the bends in the easement follows the contour of your cul-de-sac. Stephen Prokai: Yes
• The conversation easement does show a few trees. Stephen Prokai: We will not remove any existing
trees or shrubs in this area.
• How long have you lived here? Stephen Prokai: Around 2 years
Approved 1-0 with the condition Staff receives Engineering's documentation of the Consent to Encroach
