Short memo/letter introducing the project:
Juniper on Main is a restaurant under construction located at the northeast corner
of Main Street and 1st Avenue NE in Carmel. The City of Carmel Unified Development
Ordinance (UDO) Sign Standard, Section 5.39.H.2.a, states "One sign per Street
Frontage, maximum three (3) signs". Juniper on Main has 2 street frontages and is
allowed 2 signs.
When Ken Keltner applied for Sign Permits the Community Services Department
(CSD) determined that the proposed sign design for the 1st Avenue NE side of the
building was within the guidelines of the UDO and a Sign Permit was issued.
The proposed sign design for Main Street was disallowed. Because of the layout of
the Main Street frontage it was determined by CSD the only Sign Classification that
will work along Main Street is a Projecting Sign mounted on one of the vertical
columns supporting the Pergola upper beams. Since the Pergola is an accessory
structure and not a building UDO Section 5.39.H.d disallows a projecting sign being
mounted on it.
Thus; a Variance of UDO Standards is required.

Statement of Variance Request
The Owner, Ken Keltner, is asking for a Variance from UDO Section 5.39.H.d.
Because the layout of the Main Street frontage it was determined by Community
Services Department the only Sign Classification that will work for this project is a
Projecting Sign mounted on one of the vertical columns supporting the Pergola
upper beams.
Since the Pergola is an accessory structure and not a building UDO Section 5.39.H.d
disallows a projecting sign being mounted on it. Since the Pergola is considered an
accessory structure Ken is requesting a Variance to allow a projecting sign be
mounted on it.

Statement of Support
The UDO allows several Sign Classifications for Permanent Signs (Section 5.39.H.1). They
are Awning, Ground, Porch, Projecting, Suspended, or Wall.
Initially, Ken Keltner requested approval of a Suspended Sign located in the Rain Garden
just East of the Pergola. The Community Services Department (CSD) disallowed this
proposed solution. After several conversations and emails the CSD suggested a
Projecting Sign be mounted on one of the vertical columns along Main Street which
supports the Pergola upper beams. To do this a Variance from the UDO is required.

Petitioner Ken Keltner and K&E Properties, Inc.
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
The Juniper on Main Restaurant will enhance the Old Town area by adding significant
outdoor eating space. This restaurant will bring Southern Coastal Fare to Carmel.
And provide significant gathering space for visitors and residents to Carmel.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The restaurant will attract additional visitors to the Old Town area east
of Rangeline Road whice will enhance the viability of other Old Town
attractions and restaurants.
3. The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because:
The restaurant is allowed two signs; one on 1st Ave. NE and one on Main Street.
There is room in the 1st Ave. NE side yard for a hanging sign. There is NOT room in
the Main St. front yard for a sign. A projecting sign will work but requires a variance.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

Filing Dates & Deadlines Petitioner,_please note the following_
1. This item does not need to be on any meeting agenda of the Technical Advisory Committee (TAC).
2. All Mailed, Posted, and Published Public Notice needs to occur by (but may occur earlier). The
published notice (legal ad) is required within The Current in Carmel please contact them at least 11 days prior to
that in order for them to publish it on time (317-489-4444 ext. 5 or legals@youarecurrent.com). The mailing of letters
to adjoining property owners & placement of public hearing sign on the subject property is also required by the BZA
Rules of Procedure, Article VI, Section 6 (see Application and see Calendar). Make sure the public notice meeting
time in the newspaper, on the sign, and in letters to neighbors read 5:15 PM and i ha L the location reads Carmel City
Hall Caucus Rooms, 1 Civic Sq.,2nd Flr, Carmel, IN 46032.
3. The Filing Fee and 8 Informational Packets (paper copies) must be delivered to BZA administrative assistant
Joe Shestak no later than Noon, Friday, June14. (Failure to submit Informational Packets by this time will result in
the automatic tabling of the petition.) Please include the following in your Info Packets:
a) Short memo/letter introducing the project
b) Statement of Variance request(short paragraph explaining what you are asking for)
c) Statement of Support(short paragraph explaining reasons supporting the request, including analysis and
comparisons of what is allowed vs. what is proposed)
d) Location Map
e) Reductions of all plans(site plan, aerial photo of site, signage design specs, etc.)on
8.5"x11" or 11"x17" paper.
f) Page 10 of app.—Ballot Sheet(leave blank except for Docket No. & Petitioner)
g) Page 11 of app.—Findings of Fact sheet(question sheet filled out, statements completed)
h) Any other pertinent information for the Board to explain this request(such as letters of support, etc.).
4. The Proof of Notice needs to be received by this Department no later than .:oon, Wednesday June 19. Failure
to submit Proof of Notice by this time will result in the tabling of the petition.
5. This item will appear on the Monday, June 2 agenda of the Board of Zoning Appeals ng Officer under
Public Hearings, t 5:15 PM.
6. The petitioner needs to provide a Ballot Sheet and a fully filled-out Findings-of-Fact sheet for each
docket/petition the night of the meeting for the Board's use (Sheet 11 of the application). On Ballot sheets, only fill out
docket number, petitioner, and date (Sheet 10).
7. Either the Petitioner or someone representing the Petitioner must be present at the meeting to present the item
to be heard. If no one appears, it will be tabled.

Review Comments - Petitioner,_please respond in writing to the following by June 14:
a) Please make checks payable to City of Carmel.
b) Provide a copy of the Official List of Adjacent Property Owners from the Hamilton County Auditor's Office. (Make
sure to check `Carmel BZA'on their form.)
c) *The Current in Carmel only prints on Tuesdays, and their filing deadline is usually 7 days prior to their printing
date. Please submit your legal ad to them by 2:30 PM on Tuesday, June 4 so that it prints on time. Their contact info
is 317-489-4444 ext. 5 or legals@youarecurrent.com. (Use the Notice of Public Hearing form in the Application as a
template for what to have published in the newspaper and what to mail out to the neighbors.)
d) The mailings/notices to the neighbors should be done by first class mail with Certificate of Mailing(not Certified
Mail). Please provide us with the certificate of mailings for the file on or before June 19.
e) Please provide the filled out& notarized Placement of Public Notice Sign Placement Affidavit once the sign is
placed.
f) Please provide the filled out& notarized Petitioner's Affidavit of Notice of Public Hearing form.
g) Please provide the filled out Notice of the Public Hearing form/template.
h) Please provide proof of notice, such as Publisher's Affidavit from the newspaper, receipts from the Post Office,
etc., once you receive them.
i) Please provide the total sign package and design details &locations for the site.
j) Please provide the design details for the requested projecting sign, including how tall it will be and also how
close it will sit to the sidewalk.
k) Please make sure to list out the true practical difficulties and hardships associated with having to comply with the
zoning ordinance.
I) Additional review comments from the Planning/Zoning Department will be issued within the next few weeks,
through ProjectDox, our ePlan review software.
