The barn will contain a half sized basketball court. The shed will contain primarily lawn equipment. The buildings total 4920 ft. The proposed 600 ft. shed alone would be allowed under sect. 5.02(B)3b. However the proposed square footage of the barn and its roof midpoint height exceed the allowances under sect. 5.02(B)3b. Together the shed and barn exceed the allowed footprint size. Statement of Support The proposed buildings will be located more than 950 feet from the nearest public road. The proposed location is surrounded on three sides by mature trees and partially by the residence on the fourth side which will obscure the building's view from the neighbors. The proposed side setback(28ft) and rear setback(79ft) exceed the required distance for accessory building side and rear setbacks of 5 ft. The lot size is 2.8 acres. Had the lot size been 3 acres or larger there would have been no need for a square footage variance, only the height variance. The proposed height variance for the barn is 24.5ft and the allowed height is 18ft. Many of the trees surrounding the barn exceed 24.5ft which will help further obscure the barn. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the barn will be used for playing basketball for the enjoyment of the homeowner's family. The shed will be used primarily for lawn/garden equipment. There will be no reason for the general public to encounter the buildings which are over 950 feet from Hoover Road. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the barn and shed are set far from the street and property lines. And the investment in a quality barn and shed will increase the value of petitioner's property. 3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical difficulties in the use of the property because: a regulation sized half basketball court and the desired ceiling height can not be achieved under the ordinance guidelines. DECISION It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
