The applicant seeks the following development standards variance approval: 5. Docket No. 19050024 V UDO Section 5.39.H.5.d Projecting sign on building only allowed; sign on accessory structure requested. The site is located at 110 E. Main St. It is zoned B2/Business and Old Town Overlay, Character Subarea. Filed by Jim Streeter of Innovative Planning, LLC, on behalf of Ken Keltner and K& E Properties. General Info & Analysis: The Petitioner seeks variance approval to erect a 12 inch by 16 inch projecting sign on a pergola accessory structure that sits in front of the building. It will have 8 feet of clearance beneath it. Please see the Petitioner’s informational packet for more detail on the variance request. The Petitioner is allowed to have 2 signs on the site, since it is a corner lot that has 2 street frontages. One of the signs will be located along the 1st Ave SE frontage. The other sign is proposed to be located along Main Street, attached to the south side of the pergola outdoor dining area structure. Although UDO (Unified Development Ordinance) Section 5.39.H.5.d does not directly address accessory structures, the section does stipulate that projecting signs “may not extend more than 5 feet from the face of the building” (iv). The proposed sign is not on the building, and is therefore more than the maximum of 5 feet from the building. Additionally, the UDO reads ”May be utilized only when the building on which it is to be established has a Front Yard with a depth of less than 15 feet” (i). (The front yard for Juniper on Main is roughly 17 feet wide, along its Main Street frontage.) The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this variance request.
