WOODLAND FIFTH SECTION Plat Book 2, page 8c;._
We, the undersigned, Robert E. Fisher, Judith A. Fisher, Robert
B. Wells, Genevieve S. Wells, Irwin L. Staton, and Virginia Staton
owers of the above described real estate, do hereby certify that we
do hereby lay off, plat, and subdivide the same in accordance with
this plat and certificate .
This subdivision shall be known and designated as Woodland,
Fifth Section.
The streets, if not heretofore dedicated,are hereby dedicated to
the Public use. Streets to be constructed as per specifications now
on file with the Hamilton County Commissioners .
There are strips of ground five (5) feet in width as shown on
this plat marked "Utility Easements" which are hereby reserved for use
of public utilities for their installation and maintenance of poles,
mains, lines, wires, ducts and drains, subject at all times to the
proper civil authority, owners shall take their titles subject to
the rights of such public utilities, and to the rights of the owners of
the other lots in this subdivision, for ingress and egress in, along,
across and through the several strips so reserved.
All lots in this subdivision shall be known and designated as
residential lots . No structure shall be erected , placed , altered, or
permitted to remain on any residential lot herein other than one
detached dwelling, nor to exceed more than two (2) stories in height
and a private garage for not more than three (3) cars and residential
accessory building.
Building lines as shown on thiskplat in feet back from the street
property lines, are hereby established , between which lines and the
street property lines shall be erected or maintained no structure of
any kind, or part thereof, other than a one-story open porch.
There shall be provided a side yard on each side of the dwelling
5\14iL equal in width to fifteen (15) percent of the width of the lot , or
�� fifteen (15) feet wide, whichever is the lesser . No dwelling or
appurtenant structure, except fences, shall be located within said
side yard, unless varied by the proper civil authority, if buildings
are erected on more than one single lot, this restriction shall
apply to the side lines of the extreme boundaries of the multiple lots .
No fence shall be erected on or along any lot line, nor on any
lot, the purpose of which is to obstruct reasonable vision, light,
and, air, and all fences, shall be kept in good repair, and erected
reasonable so as to enclose the property and decorate the same with-
out hinderance or obstruction, to any other property . No fence shall
be erected between the front property lines and the building set-back
line other than a fence of decorative nature, not exceeding three (3 )
feet, six (6) inches in height .
No fence, wall, hedge or shrubs or other planting which obstructs
sight lines between two (2) feet and six (6) feet above the roadways
shall be placed or permitted to remain on any corner lot within the
triangle formed by the street property lines and a line connecting
them at points twenty-five (25) feet from the intersection of the street

property lines, or, in the case of a rounded prperty corner, from the
intersection of the street property lines extended the same sight-
line limitations shall apply on any lot within ten (10) feet from
the intersection of a street property line with the edge of a drive
way or alley pavement . Nottree shall be permitted to remain with_,
such intersections unless the foliage line is maintained at sufficic , .`�
height to prevent obstruction of such sight lines .
No hotel building, boarding house, mercantile building, factor/
building, or building of any kind for commercial use shall be erected
or maintained on any lot in this subdivision.
No trailers, shacks, or outhouses, of a permanent or temporary
nature, shall be erected or structed on any lot herein, except that
during the period of construction of a proper structure, which is for
the use of the builder for his tools and materials .
No private or semi-private water supply and/or sewage disposal
system may be located upon, or adjacent to, any lot or lots in this
sub-division which is not in compliance with regulations or procedure
as provided by the Indiana State Board of Health or other civil
authority having jurisdiction. No septic tank or obsorption field
shall be located or constructed except as approved by said Health
Authority, nor shall any other method of sewage disposal be installed
or used on any lot or lots herein.
No building shall be erected placed , or altered on any lot in
this subdivision until the building specificiations , and plat showing
the location of such building, have been approved in writing, as to
the conformity and harmony of external design with existing structures
in this subdivision and as to location of the building cdth respect to
topography and finished ground elevation, by a committee composed of
Harry E. Cooler, Robt E. Fisher and Robert B. Wells, or by a repre-
sentative designated by the members of said committee , unless the
committee shall fail to act upon any plans submitted to it for approval
within a period of fifteen (15) days from the submission date of same, t ,
then the owner may proceed with the building according to the plans
submitted, which plans , however, shall not be contrary to any provis-
ions, covenant, condition or restriction named in this instrument ;
the failure of such committee to act within fifteen (15) days shall
be deemed an approval of the plans submitted . Neither the committee
nor its duly designated representative shall be entitled to any
compensation for services performed pursuant to this covenant . The
powers and duties of such committee, and of its designated representa-
tives, shall cease on and after June 1st , 1965. Thereafter the approval
described in this covenant shall not be required, unless , prior to
said date and effective thereupon, a written instrument shall be exe-
cuted by the then record owners of a majority of the lots in this
subdivision and duly recorded, appointing representative or representa-
tives, who shall thereafter exercise the same powers previously
exercised by said committee .
The ground floor area of the main structure , exclusive of open
porches and garages, shall be not less than twelve hundred (1200) feet .
If the parties hereto, or any of them, or their heirs or assigns
shall violate or attempt to violate any of the covenants , restrictions
provisions of conditions herein, it shall be lawful for any other
_person owz2ing any real property situated in this subdivision to prsP-
cute any proceedings of law or in equity against the �erso_n r_punns

prevent him or them from doing so, or to recover damage or other duos

These covenants are to run with the land and shall be bindl_ig
on all parties and all persons claiming under them until June lsc,
�1975, of which time said covenants shall be automatically extended
for successive periods o en 10) years, unless by a vot r a
