The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: This variance, if approved, will allow a constructed home to exist 5 feet closer to the property line than allowed per the side yard minimum established in the PUD. This home will still lie within the property limits and will not affect the public items mentioned above. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The adjacent property owner to the north is aware of this variance and in order to assist with the approval of this variance, and curb appeal of the two side by side homes, has agreed to construct a home with a right-hand side load garage which will provide guaranteed separation. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Home that is completely constructed and occupied will have to be demolished and shifted approximately 5 feet, and start construction over. A 3rd party staked the home location on this lot based on some plat dimensions that were incorrect and created this shifted home placement. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. 19050025 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
