Hazel Dell parkway is seeking a variance for a new ground sign with 0’ setback from Right of Way. The sign will consist of a brick monument with sign panels on both sides to identify up to (4) tenants in the building. UDO Section 5.39.I.b.i requires a 5’ setback from the right of way. The proposed sign has a 0’ setback. The proposed sign complies with all other sign regulations. There are many mature trees between the MOB and Hazel Dell Pkwy that block the view of building and any existing or future wall signs on the building. This has created a significant need for a property designed, multi-tenant ground sign close to the parking lot entrance. The proposed ground sign has 0’ setback from the Right of Way because of this mature tree line. The trees make the sign nearly impossible to see from various angles. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The sign does NOT extend into the right away. The sign sits behind a sidewalk that runs along Hazel Dell. It is not next to the driveway and allows for plenty of visibility for motorists pulling out of the development. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The sign is tastfully designed to match architecture and surrounding signs. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: If the sign is placed behind the 5' setback, it will be behind existing mature trees that make it very difficult to see/read. These same mature trees hide the building, which makes wall signs impossible to see. This ground sign is needed to identify tenants within the MOB. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
