The project is located between 116th Street and 121 Street along the east side of West Road which has now been extended from 121'Street to 116th as part of the Sanctuary and Waterfront projects. Please refer to the site map on page 3. Some previous sections of the Waterfront of West Clay have been replatted over the past two years to reconfigure the lots to accommodate larger houses that are being sold in this community. The variance being requested is a result of home buyers demanding larger homes on smaller lots. The variance is being requested for lots currently platted east of West Road as well as lots that are under construction along the north side of the existing lake which will be called Section 5-A and future lots that will be developed north of Section 5-A that extend up to 121 st Street. Statement of Variance The Waterfront of West Clay is zoned S-1/Residential ROSO III. Per the Unified Development Ordinance (UDO)Section 2.04,the front building setback requirements are as follows: 1. Dwelling with attached,front loading garage: Twenty(20)feet for the dwelling and twenty-five (25)feet for the garage. 2. Dwelling with attached,side-loading garage: Fifteen(15)feet for the dwelling and twenty-five (25)feet for the garage. 3. Dwelling with attached,rear-loading,or detached,alley-access garage: ten(10)feet for the dwelling The variance request pertains to Item 2 above. The request is to allow for a dwelling with a side-loading garage to be: Twenty(20)feet for the dwelling and twenty(20)feet for the garage. Statement of Support The need for a garage setback of twenty-five(25)feet for a front-loading garage is understandable since it will allow for a vehicle to be parked outside the garage without blocking the sidewalk along the street right-of-way. However,with a side-loading garage placed at twenty(20)feet from the front lot line,the space to park outside the garage is much greater since vehicles can park facing the garage door,(parallel to the street)or along the front of the garage door(parallel to the garage door.) The minimum parking length in a driveway with a side- loading garage set at twenty(20)feet will be: 20 ft.(front setback)+20 ft(min.width of 2-car garage)=40 ft. Paul Shoopman has been in the home building industry for nearly 49 years. He is a resident of the Waterfront of West Clay with his wife of 46 years and has lived on the property for 30 years. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The front setback variance being requested applies only to a home with a side-loaded garage. This variance will not create a situation where a vehicle cannot be parked in a driveway without blocking the public sidewalk. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The architectural integrity of each house will be preserved. Since the public view of the portion of the house closest to the street will be of the side wall of the garage which will have the same architecture as the dwelling, the value of adjacent properties will not be affected. 3.
