County, Indiana, described as follows :
Beginning on the East line of the Southeast Quarter of Section
24 , Township 18 North, Range 3 East 898 . 75 feet North 00 degrees
00 minutes 00 seconds (assumed bearing) from the Southeast corner
of said Southeast Quarter; thence South 88 degrees 42 minutes 50
seconds West parallel with the South line of said Southeast
Quarter 758 . 70 feet to an iron pipe found; thence North 00
degrees 34 minutes 19 seconds East 143 . 75 feet to an iron pin
set; thence North 88 degrees 42 minutes 50 seconds East parallel
with said South line 757 .27 feet to the East line of said
Southeast Quarter; thence South 00 degrees 00 minutes 00 seconds
on said East line 143.71 feet to the place of beginning.

PARCEL II:
A part of the Southeast Quarter of the Southeast Quarter of
Section 24, Township 18 North, Range 3 East in Hamilton County,
State of Indiana described as follows :
Begin at a point 330 . 25 feet North of the Southeast corner of
said section. Run thence West parallel with the south line of
said Section 853 feet to the east right-of-way of Monon R. R.
Thence northwesterly on a curve along said right-of-way 620 feet.
Thence east parallel with south line of said tract 1099 . 1 feet to
the east line of said section. Thence south on said east line
568 . 5 feet to the place of beginning.
Except: Begin 330 . 25 feet north and 137 . 2 feet west of the S.E.
corner of said section, run thence Northeasterly on a curve 331
feet to a point on the east line of said section, said point
being 556 . 95 feet north of the S.E. corner of said section.
Thence north on said east line 76 feet. Thence southwesterly on
a curve 332 feet, thence east 75 . 8 feet to place of beginning.
Said tract being the Indiana R. R. right-of-way, leaving 12 acres
in the first said tract.

East, run thence west parallel with the South line of said
Section, 853 . 0 feet to the East right of way of the Monon R. R. ,

feet to an iron stake, thence east parallel with the south line
of this tract 280 . 0 feet to an iron stake; thence South parallel
with the East line of said Southeast Quarter 200 . 0 feet to an
iron stake, thence east parallel with the South line of this
tract, 653 . 0 feet to a point at intersection with the said East
line, thence South 50 .0 feet to the place of beginning,
containing 2 . 10 acres more or less, which tract was later deeded
to Richard B. Smith and Janet C. Smith, husband and wife, on
September 5, 1961 (recorded September 14 , 1961 in Deed Record
170, page 183) , leaving 9 . 90 acres in the first said tract .

BEFORE THE CARTEL BOARD OF ZONING APPEALS

Notice is hereby given that the Carmel Board of Zoning
Appeals meeting on the 23rd day of September, 1991 at 7 : 00 p.m. ,
in the Council Chambers, 2nd floor of City Hall, 1 Civic Square,
Carmel, Indiana 46032 will hold a Public Hearing upon an
application requesting a Special Use pursuant to Section 22 . 3 . 1
( 1) and 22 . 3 . 1 ( 7 ) of the Zoning Ordinance of the City of Carmel,
Indiana, to change the natural grade of Parcels 1 and 2 through
fill and excavation and to improve the channel of the existing
creek.
The application being known as Docket No. . The
real estate affected by said application is located on the west
side of North Rangline Road at approximately 900 North and is
more particularly described on Exhibits "A" and "A-1 " attached
hereto.
All interested persons desiring to present their views on
the above application will be given the opportunity to be heard
at the above-mentioned time and place . Written objections to the
proposal that are filed with the Secretary of the Carmel Board of
Zoning Appeals before the hearing will be considered.
A copy of the proposal is on file at the Carmel Department
of Community Development, 1 Carmel Civic Square, Carmel, Indiana .
Oral comments concerning the proposal will be heard at the
hearing.
Hearings may be continued from time to time as found
necessary.
