The regular meeting of the Carmel Board of Zoning Appeals was
brought to order by Chairman, Jim Miller, at the City Council
Chambers on October 28, 1991 at 7 P.M.
The board members present were : Jim Miller, Richard Klar, Caroline
Bainbridge, Wm. Clem and Hal Thompson .
The staff members present were : Rick Brandau, Mike Hollibaugh,
Karen McClure of Campbell Kyle & Proffitt and Dorthy Neisler.
Mr. Klar moved to approve the September 24, 1991 minutes as
presented.
Mr. Thompson seconded.
Unanimously approved.
F. COMMUNICATIONS, BILLS, EXPENDITURES AND LEGAL COUNCIL REPORT .
There was a vote taken by the board regarding the December
meeting. The December Board of Zoning Appeals meeting will
be held on December 16, 1991 . Location will be announced.
G. PUBLIC HEARING
lg. 7 : 00 P.M. , Public Hearing on Docket No. SU 59-91 a
Special Use Application for Herman D. and Judith R.
Sierzputowski and Mary B . Smith and their property
located in the 900 block, on the west side of North Range
Line Road, just north of the Smith Funeral Home, Carmel .
Petitioners are requesting special use approval to change
the natural grade of both parcels through fill and
excavation and to improve the channel of the existing
creek. Both parcels are zoned B-2 .
Filed by James J. Nelson, Attorney for Herman D. and
Judith R. Sierzputowski and Mary B. Smith.
Mr. Brandau passed out a letter received from Randy D. Powell, City
Engineer regarding this project . (which is a part of the official
minutes and attached to the Master Copy) .
The public hearing was opened at 7 : 10 P.M.
Mr. Jim Nelson, 3663 Brumley Way, Carmel, made the presentation,
a copy of which is on file at the Carmel Department of Community
Development .
An aerial view was displayed.
Mr. Daryl Edwards of Paul I . Cripe, Inc . was present .
There were no comments from the public at this time .

The public hearing was closed at 7 : 13 P .M.
Mr. Brandau stated that notification has been made to the property
owners and they have not had any opposition .
Mr. Klar moved to approve Docket No . SU 59-91 as presented.
Mr. Clem seconded.
Findings of Facts were completed by all board members .
Unanimously approved.
2g. THIS ITEM HAS BEEN TABLED AT THE REQUEST OF THE
PETITIONER.
7 : 00 P .M. , Public Hearing on Docket No . A 63-91 an
application for an Appeal of a Decision of the Director
of the Department of Community Development . The
applicant, Carmel Dad ' s Club, Inc . is appealing the
administrative determination that the applicant must
construct a dam and detention area . Parcel is zoned S-
1 .
Filed by Robert F. Campbell for the Carmel Dad' s Club,
Inc .
3g. 7 : 00 P .M. , Public Hearing on Docket No . SV 64-91 a
Developmental Standards Sign Variance Application for
John S . Kirby and Jean H.Kirby and their property located
at 1001 Third Avenue , S .W. , Carmel . Petitioners are
requesting a variance from section 25 . 7 . 04-1(d) ii of the
Carmel/Clay Zoning/Sign Ordinance to allow a second sing
on one of the complex frontages . Parcel is zoned I-1 .

Kirby.
The public hearing was opened at 7 : 20 P .M.
Mr. Steve M. Brown, Attorney, 1220 Hemlock St . , Carmel, made the
presentation, a copy of which. is on file at the Carmel Department
of Community Development .
Mr. John Kirby was present .
Pictures were distributed to all board members .
There were no comments from the public at this time .
The public hearing was closed at 7 : 26 P .M.
Staff recommendations were noted.
Mr. Klar moved to approve Docket No . SV 64-91 as presented.
Mr. Clem seconded.
