The Carmel Clay Public Library Building Corporation, and then it will be
leased to the Carmel Clay Public Library to be used as a public library.
NOTE:
LEGAL NOTICE shall be published in the Noblesville Daily Ledger a MANDATORY twenty-five (25) days prior to
the public hearing date. The certified "Proof of Publication"affidavit for both newspapers must be available for inspection
the night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice are
recommended:
1) CERTIFIED MAIL - RETURN RECEIPT REQUESTED sent to adjoining property owners. (The white receipt

FINDINGS OF FACT-DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health,safety,morals and general welfare
of the community because:
Permitting the Library to have parking spaces located further than 300 feet from the building permits
accessibility to the facility for those patrons who walk to the Library and to those that arrive by motor
vehicle. Therefore,approval of this Variance will not be injurious to the public's health,safety,morals or
general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
Allowing parking spaces further than 300 feet from the building enables the patrons of the Cannel Clay
Public Library easy access to the facility. Thus,the use and value of the area adjacent to the property will
not be affected in a substantially adverse manner.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
Without the ability to allow patrons of the Library to have proper access to the Library,the Library's
abilities to service the community are limited.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards
Variance Docket No. is granted,subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.

filed. Purchase agreements have been reached with all of the property owners, with the
exception of Marilyn Thomas' property. Negotiations for Marilyn Thomas' property is
presently in progress.
7. (1) Developmental Standards Variance to exceed height requirements in an R-2
Residential District from 25 feet to 50 feet (8.4.1) and(26.1.1).
(2) Developmental Standards Variance to allow a parking lot on property, not located
on the same lot with the building served. (27.2.1).
(3) Developmental Standards Variance requesting relief from the requirement that
parking spaces be located on an area within 300 feet of the building (27.2.2).

8. a. Due to the design of the proposed building, it will exceed the maximum height
permissible for a building located in an R-2 zoning classification. The maximum
height allowed is 35 feet(26.1.1). The proposed building will be no more than 50
feet in height, and that height is only applicable to certain architectural aspects of
the building. The actual roof top height is approximately 37 feet. The Cannel
High School,which is across the street from this project, is, for the most part,
higher than the proposed building. Thus,the Library's height will not be out of
character for this area.
In addition,the cost of constructing a single story structure of a size capable of
handling the needs of the Cannel Clay Public Library through the year 2020
would be cost prohibitive.
b. The location of 4th Street, which goes through the Library's property, negates the
possibility of allowing all of the building's parking to be located on the same lot
as the Library building.
c. Due to the need to accommodate the public's use of the Library and its
accessibility, it is necessary that certain portions of the parking spaces for the
facility be located further than 300 feet from the building. This provides both
accessibility to the building for those who will walk to the site, i.e., from the high
school and elementary school, and for those that will arrive by motor vehicles.
