The applicant seeks the following development standards variance approval: 1. Docket No. 19060004 V UDO Section 5.39.I.5.b.i Min. 5-ft setback from street right of way allowed; 0-ft requested. The site is located at 13250 Hazel Dell Pkwy. It is zoned B3/Business and SFHA/Special Flood Hazard Area. It is Lot 5 of Hazel Dell Corner Subdivision. Filed by Doug Staley, Jr. of Staley Signs, Inc., on behalf of GA HC REIT II Hazel Dell MOB LLC, owners. General Info & Analysis: The Petitioner seeks approval for a new ground sign to have a 0-ft setback from the street right of way. The sign ordinance requires a minimum 5-ft setback from the street right of way. (The existing sign will be removed before the new sign is installed.) Please see the Petitioner’s informational packet for more detail on the variance request. Also, a 30-ft wide Greenbelt, as well as a 30-ft wide Drainage Utility and Sewer Easement (DU& SE) runs parallel to the street right of way. The sign placement within the easement will require a Consent to Encroach approval from the Board of Public Works & Safety (BPW). Due to the sight lines from Hazel Dell Road, this sign location gives it the best visibility. There are street trees and landscaping, as well as electrical transformers, in the view shed. The landscaped sign will still be located around 9-10 feet west of the multiuse path. The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports this variance request, with the condition listed below. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 19060004 V, with the condition of the Petitioner gaining Consent to Encroach approval from the BPW.
