Color photos of proposed (or similar) improvement and any major materials to be used. C. Construction Plans and/or drawings of proposed improvement, as applicable. D. Homeowner Acknowledgement. Homeowner acknowledges and agrees to the following: Homeowner is required to obtain written approval from the Architectural Review Board ("ARB") before making any changes or improvements to property. No changes or improvements are permitted to be started prior to receipt of the ARB's written approval. ARB has up to thirty (30) days from receipt of all required materials to review and respond to each change request. If Homeowner receives no response from the ARB within said thirty (30) days then the request is to be considered denied. Homeowner has read and will fully comply with the subdivision's Declaration of Restrictions and Guidelines for Architectural Approval ("Guidelines") in their entirety. Homeowner is responsible to research and adhere to all guidelines for the subdivision. ARB does not bear any responsibility for ensuring structural integrity or soundness of approved construction or modifications, nor for ensuring compliance with building codes, zoning or PUD ordinances, and/or other governmental requirements. Upon sale of the property, Homeowner is responsible for transferring to the new Homeowner a copy of all ARB approvals applicable to the property. Homeowner is responsible for any and all damages to residential or common area irrigation systems which may result from the installation of the improvement. Homeowner is responsible for all clean-up of projects and will make sure all debris, sod, soil, etc. are removed and hauled to proper waste sites. Prior to excavation, Homeowner is responsible for location of all underground utilities by calling 811 or going to www.811 now.com. Digging should not commence until underground utility locations are marked. Homeowner is responsible for obtaining any necessary building permits. Jackson's Grant - ARB Request Form - CMS - rev 9-1-18 Page 2 of 3 If any work does not conform to the approval of the Architectural Review Board, and the Declaration of Restrictions and Guidelines for Jackson's Grant, Homeowner acknowledges their liability for all costs necessary to bring the work into compliance, including any necessary legal fees. For any improvement encroaching upon or causing injury to any Adjacent or Public Property; Common Area; Utility, Drainage or Sewer Easement; Landscape or Landscape Preservation Easement; or Lake Easement, or that could possibly block access to certain utility meters or equipment, then Homeowner accepts full responsibility of any costs to remove and/or replace the improvement if the utility company, association or developer requires access to any such area. Prior to installation, Homeowner must obtain permit/approval from Hamilton Co. Drainage Board for encroachment into Regulated Drain Easements (RDE) and applications for any encroachment must be submitted to Hamilton Co. Surveyor's Office at One Hamilton County Square, Suite 188, Noblesville, IN 46060 (ph. 317-776-8495). For any encroachment into an easement, Homeowner must also obtain any permit/approval as may be required by any other entity with jurisdiction, prior to installation. Requests to replace/exchange a "street tree" in the right-of-way area in front yard of home may only be with the same type of tree due to restrictions set forth by area municipalities. Pursuant to Section 8, all requests MUST include a Surveyor's Plot Plan with location of proposed change drawn to scale, applicable construction plans, AND example photo(s) for proposed improvement. All deposits are non-refundable to cover restocking construction schedule voids & lost time fees. Mud Stingers reserves the right to post a sign on customer property for construction process. Any alteration of deviation from the specifications involving extra costs will be executed only upon written change orders, and will become an extra charge over and above the proposal. Upon delivery of equipment & materials to the said project location the customer assumes full liability for said materials & equipment. Others, if required, shall provide building or any other permits. We assume no responsibility for and shall be held harmless for liability of damage to or interference with sub -surface structures, services, or utilities of which the exact location has not been previously established and made known to us, even in the event of an exact location & not an approx. marking Mud Stingers still is not held liable for damages. Homeowner must acknowledge that there can be collateral damage during the construction process in the form of damaged yard, trees, shrubs, flowers, sprinkler systems, invisible dog fence, wood decks or fencing etc, if this cannot be avoided to complete the project Mud Stingers is not held responsible for replacement of these items, furthermore patio furniture, grills, fences & yard accessories will be moved or covered prior to the construction by the homeowner, Mud Stingers is only responsible for the city "rite of way" from rite of way to the city street, all other is homeowners responsibility Mud Stingers can replace on a time & material basis to be agreed upon with homeowner Also any unordinary excavation conditions such as, boulders, rocks, concrete, sub -surface water or de -watering due to natural springs, rain & acts of god or structural problems will be assessed at time of discovery and an additional charge will be written in an addendum and signed before work will continue. Mud Stingers is not responsible for the pre-existing water drainage issues, downspouts, bubblers, gutters or leach drains, further more Mud Stingers will not be held responsible for homeowner maintenance of these said items which could affect the drainage of any concrete or trench drains that Mud Stingers installs. This proposal subject to acceptance within 30 days and is void thereafter at the option of the above signed. Work will be kept to a specific schedule set by only Mud Stingers, Any direct contact with Mud Slinger employees or sub -contractors if used regarding any Mud Stingers accounts, vendors, suppliers or past, current or future projects without written consent can be considered detrimental to the project & may void any/all warranties on said project. If any contractors or subcontractors hired by owner perform any work on a Mud Stingers project without prior written approval by Mud Stingers will void any & all warranties from Mud Stingers. All recordable rain days will delay the schedule by a minimum of 3 working days, this not only pertains to said site but possible other sites that have been scheduled ahead of said site, weather & construction delays cannot be predicted & therefore no compensation, credits or monies can be given for lost time, this does not include any alternates, add-ons, options or change orders which will add on to construction time. Pool season construction officially begins April V' , however Mud Stingers could possible start construction in the month of March but all construction during march will not count against standard build time. If this deems a problem please specify that you do not want to begin prior to April. A payment schedule will be established before work has begun, any payment not made according to the payment schedule will stop the project at that point & the project will be taken off of the schedule until payment is made current at which point the project may lose its place & be moved to a new place of seniority among other active projects. Any past due payment beyond 30 days will be subject to liquidated damages amount to be determined by Mud Stingers with -in reason @ a minimum or 1.5% & will compound daily until satisfied .If any of owed monies to Mud Stingers are not satisfied within the agreed payment schedule, then any & all warranties for all equipment & work become void & Mud Stingers reserves the right not to resume the warranties once monies have been satisfied. Final payment shall be due upon completion of said work. For the purpose of trade secrets & construction process confidentiality Mud Stingers reserves the right to not have any audio or video recording. Mud Stingers reserves the right to pursue all legal means for recovery of monies owed & furthermore, Mud Stingers reserves the right to collect all monies unpaid or past due balances for furnishing any material, labor or machinery for the "alteration or repair" or for furnishing material, labor or machinery for the "original construction" pursuant to Indiana Code, Title 32 — Property, Article 28 — Liens on Real Property.
