Findings of Fact for Primary Plat TAB 1 Summary of Commitment and Plan Enhancements 1. Pond buffer (landscape plantings) will be provided. The perimeter of the pond will be panted as a wildlife habitat and the Open Space Plan will be updated as required under the UDO. 2. A Path was added around the pond to create an enhanced passive amenity. The Site Plan was amended to show the location of the path. 3. Architecture (regarding the below architectural items the commitments included under Tab 7 were amended accordingly to address the enhancement and DOCS Staff was provided a red line version in order to confirm all required revisions): a. The Commitments now require 50% of the homes to have masonry on the first floor of the front façade with all other homes having masonry to window sill of lowest window. b. The Commitments now require a masonry base wainscot at a minimum on all side and rear elevations of all homes. c. The Commitments now require to two (2) windows per façade for all ranch homes and three (3) windows per elevation on each façade for a 2-story home based on the plans on file (see Tab 5). If there is an elevation which does not include 3 windows on a two story 3 will not be required. d. The Commitments now require all windows not surrounded by masonry to be trimmed (1” by 4” nominal board). e. The Commitments now require an exterior chimney, where provided, to have full height masonry. f. The Commitments now allow no more than five (5) homes to have a front load garage (if necessary). The Commitments require side or courtyard load garages but provide front load as an alternative only where there is an issue with easements and a unique lot configuration. g. The “anti-monotony” standards will included compliance with the UDO and the color provisions on the Commitments. 4. Playground equipment will be provided in the Common Area as identified site Plan. A detail of the quantity and style of Playground is provided in the Commitments. 5. Sign materials were updated and placed on file with DOCS Staff. 6. Product Photographs: Photographic examples of homes have been provided at the end of Tab 5. 7. Lot Landscaping: The Commitments have been amended to require all homes to have fifteen (15) shrubs and two (2) trees in the front yard. Additionally each home on a corner lot where the driveway does not face the street shall provide an additional fifteen (15) shrubs and one (1) tree in the corresponding front yard. 8. A draft copy of Covenants was provided to DOCS Staff.
