The maximum six (6') tall fence, proposing a maximum eight (8') tall fence. (UDO Section 5.09.C); FINDINGS OF FACT 1. The approval of the requested variances will not be injurious to the public health, safety, morals and general welfare of the community because: The approval of the requested variance will not be injurious to the public health, safety, morals and general welfare of the community because the requested variance would allow the Petitioner to maintain a sense of privacy due to the character and topography of the site related to the construction of the new home to the immediate north. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use and value of the area adjacent to the real estate that is the subject of the requested variance will not be affected in a substantially adverse manner because the residential character of the neighborhood would be maintained given the limited section of eight-foot(8') fencing proposed. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The eight-foot (8') section of fencing cannot be erected as proposed without the requested variance. DECISION IT IS THEREFORE the decision of the Cannel Board of Zoning Appeals Hearing Officer that Development Standards Variance Docket No. 19070007 V is granted, subject to any conditions stated in the minutes of this meeting, which are incorporated herein by reference and made a part hereof.
