Commitments 8. Proposed S-1 to S2 Rezone Ordinance EXPLANATION OF REQUEST The Petitioner, Lennar Homes of Indiana, Inc. ("Lennar"), has filed a Rezone application pertaining to real estate consisting of approximately 23 acres generally located at 4100 W. 141 st Street (the "Real Estate"). The Real Estate is currently zoned S-1 Residential District and is agricultural and residential in use. The Real Estate is identified on the aerial photograph included herein under Tab 2. Lennar desires to develop a residential community on the Real Estate to be known as "Troy Estates." Lennar is seeking to rezone the Real Estate from the current S-1 Residential zoning classification to the S-2 Residential zoning classification in order to develop a for-sale, single-family residential community consisting of approximately 39 homes. The anticipated sales price range of these homes will be between $450,000 to $600,000 (see Tab 5 for home product examples). An updated color site plan for the Troy Estates residential community is included behind Tab 4. In addition to Rezone request, Lennar received Primary Plat approval (see Tab 6) and development standards variances of the Unified Development Ordinance to (i) reduce the Front Yard Setback from thirty-five (35) feet to twenty-five (25) feet, (ii) provide a five (5) foot side yard and (iii) a ninety (90) foot lot width. The second and third variance requests were in response to plan revisions made to accommodate a plan with more open space along 141 St Street and homes with fronts facing that roadway as illustrated on the Site Plan. In addition, proposed lot landscaping and architectural commitments have been made and are included behind Tab 7. A copy of the Rezone ordinance is included behind Tab 8. The request received a Favorable recommendation for approval by the Plan Commission at its August 20th meeting as evidenced by the Certification of the Plan Commission recommendation. Revisions and enhancements to the proposal as a result of the Plan Commission review process are identified on the following page of this explanation. Likewise the Favorable recommendation of the Plan Commission was subject to the proposed commitments regarding home architecture and lot landscaping. Pond buffer (landscape plantings) will be provided. The perimeter of the pond will be planted as a wildlife habitat and the Open Space Plan will be updated as required under the UDO. 2. A Path was added around the pond to create an enhanced passive amenity. The Site Plan was amended to show the location of the path. 3. Architecture (regarding the below architectural items the commitments included under Tab 7 were amended accordingly to address the enhancement and DOCS Staff was provided a red line version in order to confirm all required revisions): a. The Commitments now require 50% of the homes to have masonry on the first floor of the front façade with all other homes having masonry to the window sill of lowest window. b. The Commitments now require a masonry base wainscot, at a minimum, on all side and rear elevations of all homes. c. The Commitments now require two (2) windows per façade for all ranch homes and three (3) windows per elevation on each façade for a 2-story home based on the plans on file (see Tab 5). If there is an elevation which does not include 3 windows on a two story, 3 will not be required. d. The Commitments now require all windows not surrounded by masonry to be trimmed (1" by 4" nominal board). e. The Commitments now require an exterior chimney, where provided, to have full height masonry. f. The Commitments now allow no more than five (5) homes to have a front load garage (if necessary). The Commitments require side or courtyard load garages but provide front load as an alternative only where there is an issue with easements and a unique lot configuration. g. The "anti-monotony" standards will includ compliance with the UDO and the color provisions on the Commitments. 4. Playground equipment will be provided in the Common Area as identified on the Site Plan. A detail of the quantity and style of playground is provided in the Commitments. 5. Lot Landscaping: The Commitments have been amended to require all homes to have fifteen (15) shrubs and two (2) trees in the front yard. Additionally, each home on a corner lot and common area where the driveway does not face the street shall provide an additional fifteen (15) shrubs in the corresponding yard. EXHIBIT`B" ARCHITECTURAL COMMITMENTS The architectural standards set forth below shall apply to all lots and all dwellings constructed on the Real Estate. Section 1. Dwelling Design: A. Permitted Building Materials: Masonry, Wood, Cementitious Board shall be permitted siding materials. EIFS, Vinyl and aluminum siding shall be prohibited. 1. Fifty percent (50%) of all homes shall have masonry on the first floor of the front façade with all other homes having masonry to the window sill of lowest window. 2. A minimum of a masonry base wainscot shall be provided on the side and rear elevations of all homes. WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted the Carmel Unified Development Ordinance, Ordinance Z-625-17, as amended (the "Unified Development Ordinance"), the terms of which are applicable to the geographic area consisting of the incorporated area of the City of Carmel, Indiana, which Unified Development Ordinance has been codified in Chapter 10 of the Cannel City Code; and WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the map that is part of the Unified Development Ordinance; and WHEREAS, the Cannel Advisory Plan Commission has given a Favorable recommendation to this Ordinance under docket number 19050020 Z, regarding the rezoning of real estate legally described in Exhibit A and illustrated on Exhibit B, which is incorporated herein by this reference collectively, (the "Real Estate"). NOW, THEREFORE, BE IT ORDAINED by the Common Council,that: Section I: The Official Zoning Map accompanying and made part of the Unified Development Ordinance is hereby changed to designate the Real Estate from the S 1 (Residential)District to the S2 (Residential)District. Section II: All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III: This Ordinance shall be in full force and effect from and after its passage and signing.
