INTRODUCTION:
I am petitioning to build a Four Seasons room addition to the back of my home.
The new addition requested would be completely finished with quality materials and will
have windows and siding that will match the house. It will be 16' wide and 18' deep and
will be in the same general location as the existing 23' wide and 15' deep patio that will
be removed.
VARIANCE REQUEST:
The current building setback line is 40 feet; Requesting 35 feet to allow for
building the proposed Four Seasons room addition.
REASONS FOR REQUEST:
We currently have a concrete patio (in the same proposed area)that we need to
remove as it has been breaking, sinking, and sloping toward the house. This existing
patio currently extends 3 feet into the building setback line and will be removed and
replaced with the proposed addition. {The patio was present when we purchased the
home.)
Because of having Gray Road adjacent to the back of our property, we have a
deep building setback line of 40 feet. The required setback allows for very limited
options to really enjoy this space, which pushed us toward requesting a variance. The
addition will leave 35 feet as the setback. It will also still be 23 feet away from the
subdivision fence within our back yard.
SUPPORT FOR REQUEST:
The location of the room addition(and because the home is at the end of a cul-de-
sac) is such that only my adjoining neighbors would see it if they were at the deepest
locations of their properties. I have spoken directly with each of these adjoining
neighbors and have their verbal support of the improvements. Notification letters have
been mailed to all the required neighbors. I also have enclosed a copy of the HOA
approval from Sycamore Farm.

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
The applicant will hire subcontractors to do all exterior work (foundation,
framing, roof, windows, decking) to be contained to the back yard in a
safe & professional manner.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The addition will not have an adverse affect but will add value to the
residence and potentionally to the adjacent properties as a comparable
to surrounding homes.
3. The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because:
The current setback causes a very restrictive and difficult amount of space to
add an addition with features that we desire. The new setback at 35' would also
still be 23' feet from the subdivision fence and is well contained in the back yard.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.

Contingent Approval—Architectural Request#3258
August 30,2019
The Sycamore Farm Homeowners' Association Board of Directors has voted contingent approval
of Request#3258(see pages 2 & 3 of this document). The contingent approval requires that all of
the following conditions be met throughout the project. Requests for additional information, or
questions, may be directed to VP Russ Freed (317-507-2931 or russfreed@sbcglobal.net), of any
other Board member.
1. Sycamore Farm Homeowners Association ("HOA") contingent approval is subject to
approval(s) by any and all other required authorities, including but not limited to City of
Carmel department(s), and approval votes by 3 of 4 HOA Board members.
2. Any material change in the project as proposed requires submission of the changes along
with related documentation for further review by the HOA.
3. Homeowner and contractor(s) are fully responsible to obtain all other required approvals,
permits, etc., including but not limited to City of Carmel.
4. A copy of any and all required non-HOA approvals, consistent with request as presented, are
to be provided to HOA prior to commencement of construction. HOA will provide its final
approval after those approvals are received and reviewed.
5. All construction to be completed by properly licensed contractor(s)by approximately
12/31/19. Homeowner maintains sole responsibility to ensure proper insurance, by
homeowner and contractor, is maintained throughout the project. Additional time may be
granted by HOA based on final approvals and commencement of construction.
6. All required utilities location and inspections during construction are the sole responsibility
of homeowner and contractor(s).
7. In addition to exterior siding matching color& general type (ie vinyl siding) of current house
and windows to match house as contained in the request, roof material, guttering and related
colors must also match existing house.
8. Presumed construction access will be via homeowner driveway. No construction access via
Gray Road is granted or permitted without further review and separate approval by HOA.
9. Homeowner and contractor(s)to maintain orderly site during construction, including but not
limited to safety matters affecting residents, children etc. No neighboring property can be
used for construction-related activities. Construction will be performed during reasonable
hours, recognizing noise levels.
10.HOA has no liability beyond its approval for the project under the Sycamore Farm bylaws,
rules and covenants.

alteration or whose property is adjacent to yours and notify them of your proposed
improvements. This is not to get their approval but merely to be neighborly by
communicating your intentions.
1. This project is not intended to violate any of the restrictive covenants nor any of the
provisions of building and zoning codes to which the above property is subject.
Further, nothing contained herein shall be constructed as a waiver or modification
of any said restriction.
2. I am responsible for ensuring that all local permits and filing of plans with the
building inspector, at the appropriate office, will be accomplished before
construction begins.
3. I understand and agree that no work on the project that is the subject of this request
shall commence until written approval of the HOA has been received.
4. I understand that work done without approval that goes beyond the scope and
description of the application will be in violation and must be removed at the
owners' expense and the property must be returned to the condition it held prior to
the commencement of the work in question.
5. I understand that all work must be completed within 6 months of the approval date
or a new Architectural Improvement Form must be submitted for approval to the
HOA.
