Balay, RA, NCARB PO Box 847 Fishers, IN 46038 Phone: (317) 219-6615 Email: mike@balayarchitects.com Exhibit “D” SIGN VARIANCE AND PROJECT DESCRIPTION Napleton Kia of Carmel is the Applicant (“Napleton”) and is the contract purchaser of a parcel of real estate owned by DYC Realty, LLC, which parcel is approximately 3.74 acres, located generally northeast of the intersection of Randall Drive and 96th Street and depicted on the enclosed site aerial exhibit (collectively, the “Real Estate”). The Real Estate is zoned B-3 Business pursuant to the City of Carmel’s Unified Development Ordinance. Napleton previously obtained approval of an ADLS/DP request under Docket Number 19050013 DP/ADLS related to their Kia of Carmel automobile dealership (“Kia Dealership”). Napleton is filing this development standards variance request related to signage for the Kia Dealership. The Kia Dealership is a Single Tenant Building and has street frontage along Randall Drive to the west and 96th Street to the south. As a result, pursuant to the Unified Development Ordinance (“UDO”), the Kia Dealership would be entitled to two (2) total signs. The signage package that Napleton reviewed with the Plan Commission as part of its ADLS/DP approval included six (6) total signs for the Kia Dealership, which signs are described below: a. Two (2) “Napleton” Wall Signs – located on the west and south elevations. b. Two (2) “Kia” Wall Signs – located on the west and south elevations. c. One (1) “Service” Wall Sign – located on west elevation. d. One (1) “Kia” Ground Sign - located along 96th Street in the southwest corner of the site. All proposed signs meet the size requirements of the UDO. In addition to the above signage, at the request of the Plan Commission as part of the ADLS/DP approval, Napleton also agreed to install a directional sign with copy that will state “No Test Drives Through Williamson Run” on the northside of the exit drive near Randall Drive. In light of the above, Napleton is seeking a variance from UDO Section 5.39 (H) (2) regarding the permitted number of signs on a Single Tenant Building to permit Napleton to erect six (6) total signs on the Kia Dealership building. FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE 1. The approval of the requested variances will not be injurious to the public health, safety, morals and general welfare of the community because: The approval of the requested variance will not be injurious to the public health, safety, morals and general welfare of the community because the number and size of proposed signs is consistent with other automobile dealership signage in the general vicinity of the subject Real Estate and the additional signage will provide additional identification for the general public traveling on the adjacent roadways. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use and value of the area adjacent to the real estate that is the subject of the requested variance will not be affected in a substantially adverse manner because the number and size of proposed signs is consistent with other automobile dealership signage in the general vicinity of the subject Real Estate and the additional signage will provide additional identification for the general public traveling on the adjacent roadways. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Strict application of the Zoning Ordinance results in practical difficulties in the use of the Applicant’s site because absent the additional signage, the Applicant will be unable to properly and adequately identify its location to the general public traveling on the adjacent roadways. The additional signage will assist in providing proper identification which shall assist in efficient and safe wayfinding to the site. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals Hearing Officer that Development Standards Variance Docket No. ____________V is granted, subject to any conditions stated in the minutes of this meeting, which are incorporated herein by reference and made a part hereof.
