EXHIBIT C STATEMENT OF VARIANCE No. PZ19080001 V The subject lot (“Lot”) is zoned as part of the Meridian Corridor (“MC”) District. Section 2.40 of the Unified Development Ordinance (“UDO”) limits the height of an “accessory building” in the MC District to eighteen feet (18'). Section 11.02 of the UDO defines an “accessory building” as a “Building subordinate to another Structure or Use located on the same Lot which is not used for permanent human occupancy.” Applicant seeks to construct a parking garage—an “accessory building” under the UDO—on the Lot which exceeds the 18-foot height restriction. The height of the parking garage will be 41'-7" for the primary massing and 51'-0" for the stair towers. EXHIBIT D STATEMENT OF SUPPORT No. PZ19080001 V Although the Unified Development Ordinance (“UDO”) classifies the proposed parking garage on the subject lot (“Lot”) as an “accessory building,” the façade of the garage will match the exterior architectural elements of the orthopedic specialty hospital and medical office building that will be constructed on the Lot adjacent to the garage. As such, from the exterior of the Lot, the garage will look like a “principal building.” Notably, if the four-story garage were a “principal building,” it would be permitted as a matter of right, as Section 2.40 of the UDO permits a “principal building” in the Meridian Corridor District (the district in which the Lot is located) to be at least eight stories and, in some cases, up to 11 stories. Because only one principal building is proposed for the Lot (the hospital and medical building), permitting the construction of a garage that exceeds 18' in height and that looks like a “principal building” satisfies the massing requirements applicable to the Lot under Section 5.07(D)(3) of the UDO.
