A permitted land use within the B3/US 421 Overlay zoning district in accordance to the City's zoning map and comprehensive
plan will not be injurious to the public health, safety, morals, and general welfare of the community.
A permitted land use within the B3/US 421 Overlay zoning district in accordance to the City's zoning map and comprehensive plan
will not affect the use and value of the area adjacent to the property in a substantially adverse manner as the proposed property
improvements are consistent with the surrounding improved properties in use, building materials, and character.
The restrictions encumbering the subject parcel per the West Carmel Marketplace Restriction Agreement and Grant of Easements (RAGE)

in conjunction with the Zoning Ordinance have created a practical difficulty by restricting the building size/location on the property
thus affecting the overall ability to create a cohesive site improvement matching the character and intent of the US 421 Overlay Zone
STATEMENT OF VARIANCE REQUEST
Valvoline, LLC is desirous of constructing a new automotive oil change facility on 0.98 Acres located at
the Northeast corner of Michigan Road and West 98th Street within the US 421 Overlay Zone and 96th
Street and US 421 TIF District. The subject property is located on the east side of Michigan Road in
between Prime Car Wash and Burger King. The site location is outlined on the aerial photograph
attached with an address of 9835 N Michigan Road; Tax ID Parcel #: 17-13-07-04-01-001.001 & 17-13-07-
04-01-002.000.
The proposed improvements will consist of a new 2,077 sf +/- (main floor area) with lower level, 11
space parking lot, site lighting, landscaping, and drainage/utility infrastructure.
VARIANCE REQUEST:
1) Reduction in minimum gross floor area, 2,500 sq. ft. required – 2,077 sq. ft. proposed;
2) Vehicle stacking in a front yard
CITY ZONING CODE:
UDO Section 3.99 – Minimum Gross Floor Area: Each lot or parcel shall contain at least one principal
building with a minimum of 2,500 square feet of gross floor area, excluding the floor area of any
basement or any accessory buildings.
UDO Section 3.95.F - Stacking for drive-thru lanes shall be confined to the rear of the tract or parcel
with outlet from such lines also being to the rear of the building. Lines for drive-thru facilities shall not be
permitted along the front and sides of structures within the Overlay District, nor permitted to spill onto
adjoining properties.
Property History:
The petitioned property was combined from West Carmel Marketplace Block H and part of Lot 1 of
North Augusta Subdivision, Section 1 by G. William Armstrong in May, 2014 and is now known as Lot
1a, a Replat of North Augusta, Section 1, Lots 1-3, & West Carmel Marketplace, part of Block H.
Instrument No. 2014016689 in Plat Cabinet 5, Slide 205.
The property is subject to the West Carmel Marketplace Restriction Agreement and Grant of
Easements (RAGE) dated 05/17/2006 as Instr. #200600022526 that restricts competing sale of goods
and trade and limits the location and size of the proposed building on the property.
The request for is fully detailed in this submittal. We have been in communication with DOCS Staff and
Carmel Engineering in conjunction with a congruent DP/ADLS petition to be presented to the Plan
Commission on September 17, 2019.

STATEMENT OF SUPPORT
VARIANCE REQUEST:
1) Reduction in minimum gross floor area, 2,500 sq. ft. required – 2,077 sq. ft. proposed;
Due to the RAGE restrictions tied to West Carmel Marketplace, the building placement on this site is
limited to the southern portion of Lot 1A. The proposed land use is permitted within the B3 zoning
classification. The proposed facility contains a full basement area with worker platforms to perform
vehicle service, an employee break area and changing room, and inventory storage areas. The total
building square footage is 4,154 sq. ft.
2) Vehicle stacking in a front yard;
Due to the RAGE restrictions tied to West Carmel Marketplace, the building placement on this site is
limited to the southern portion of Lot 1A. The proposed land use is permitted within the B3 zoning
classification. The orientation of the building as provided eliminates the service bay garage doors from
facing directly toward Michigan Road. Vehicle stacking and queue areas are limited to the north side of
the building. This is similar to the adjacent property (Prime Car Wash) stacking queue. Customer and
employee parking will be located east of the building (rear).
