FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE

Petitioner: VALVOLINE,LLC
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
A permitted land use within the B3/US 421 Overlay zoning district in accordance to the City's zoning map and comprehensive
plan will not be injurious to the public health,safety,morals,and general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
A permitted land use within the B3/US 421 Overlay zoning district in accordance to the City's zoning map and comprehensive plan
will not affect the use and value of the area adjacent to the property in a substantially adverse manner as the proposed property
improvements are consistent with the surrounding improved properties in use,building materials,and character.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties
in the use of the property because:
The restrictions encumbering the subject parcel per the West Carmel Marketplace Restriction Agreement and Grant of Easements(RAGE)
in conjunction with the Zoning Ordinance have created a practical difficulty by restricting the building size/location on the property
thus affecting the overall ability to create a cohesive site improvement matching the character and intent of the US 421 Overlay Zone
DECISION
It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket
No. 19070017V& 19070018 V is granted, subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.
