Dear Mr. Nolting:
At the meeting held on Monday, September 23, 2019 the Carmel Board of Zoning Appeals took the following action regarding
the Special Use and Development Standards Variance (V) requests filed by you for the property located at 5459 E. Main Street:
APPROVED with Conditions: The Special Use Amendment and Variances listed below were approved with the following
Conditions: 1.) Addressing all remaining Carmel Technical Advisory Committee (TAC) member review comments (including
Carmel Engineering Dept.), 2.) The ground sign will remain and read Mark Badger Fields, and 3.) Seriously consider naming the
building ‘Jack Badger Plex’.
Docket No. 19060005 SUA: Permitted Uses, Recreational Special Use granted.
Docket No. 19060013 V: Max. 35’ building height allowed, 45’ granted.
Docket No. 19060014 V: Max. 35% lot cover allowed, 64% granted.
Docket No. 19060015 V: Lot frontage on a street required, No frontage granted.
Docket No. 19060016 V: Min. 25’ side yard building setback for semi-public buildings required, 20’ & 11’ granted.
Docket No. 19070012 V: Parking lot curbs required, No curbing granted.
Please be advised that per Articles9.09 and 9.15 of the Unified Development Ordinance, the aforementioned Special Use
Amendment and Development Standards Variance approvals are valid for three (3) years. By that time, either continuous
construction of the improvements must be underway, or a written request for a one -time, six-month extension of the approval
must have been received and approval granted by this Department. The expiration date of the approval is September 23, 2022.
