Box 44127, Indianapolis, IN 46244 Phone 317-262-4989 Fax 317-262-5212 September 9, 2019 Tim & Molly Hull 12619 Pembrooke Circle Carmel, IN 46032 Dear Tim & Molly: The Architectural Review Board (ARB) for the Claridge Farm Homeowners Association has reviewed your request to install a 20’ x 20’ 3 season screen porch addition in your backyard and is pleased to inform you that it is approved on the basis of the information you provided with the request. The approval of the 3 season screen porch does not supersede any obligations or requirements for the homeowner to maintain its property in compliance with the Covenants and Restrictions. If you choose to alter anything from the original request, you must first submit this change to the ARB. In addition, please be aware of the following: 1. It is your responsibility to determine and obtain any approvals, permits and/or surveys required. 2. You must understand that the Declaration of Covenants and Restrictions relating to the property specifically provide: No structure, including fences, shall be built on any drainage, sewer or utility easement if such structure would interfere with the utilization of such easement for the purpose intended or violate any applicable legal requirement or the terms and conditions of any easement specifically. Drainage easements are created to provide paths and courses for area and local storm drainage, either overland or in adequate underground conduit, to serve the needs of Claridge Farm and adjoining ground and/or public drainage system; and it shall be the individual responsibility of each Owner to maintain the drainage across his own Lot. Under no circumstance shall said easement be blocked in any manner by the construction or reconstruction of any improvement, nor shall any grading restrict, in any manner, the waterflow. Said areas are subject to construction or reconstruction to any extent necessary to obtain adequate drainage at any time by any governmental authority having jurisdiction over drainage, and by the Architectural Review Board. All easements include the right of reasonable ingress and egress. Declaration of Covenants and Restrictions, Section 17. The ARB makes no final determination as to whether the 3 season screen porch you intend to install may interfere with the waterflow or utilization of the easement at any time in the future. You accept the risk that installation of said 3 season porch within the Drainage, Utility, and Sewer Easements on the Plat for your Lot may violate the Covenants and Restrictions and you run the substantial risk that Claridge Farm , a utility company or any municipal agency or their respective representatives might need to enter onto such easement and perform work which may necessitate the removal or destruction of your improvement, as well as any related landscaping you may have. If this should occur, you would be solely responsible for any removal, repair or replacement. 3. All construction must be on your property and any damage to neighboring lots, association property, sidewalks or roadways must be repaired within 14 days of completion. 4. No Structure will be approved if it violates building setback lines or it encroaches on any easement. 5. All fences shall be kept in good repair. Landscaping designs and installations require prior approval of the ARB as specified in the Covenants and by the written Architectural and Landscaping Guidelines. 6. Lots adjoining the common areas are subject to more rules and guidelines regarding improvements and changes. Prior request to the ARB is required for consideration on an individual basis. 7. Neither the Board of Directors nor the ARB shall be held liable for the impacts of this project nor future revised interpretations of the Covenants and Restrictions.
