Ordinance Z-646-19 (Docket No. 19050029 Z): Smokey Row UR & P1 Rezone.
The applicant seeks to rezone 13 parcels located on the north side of Smokey Row Road, between the Monon
Greenway and Meridian Street, from the PUD/Kensington Green Planned Unit Development and R1/Residence
District to the UR/Urban Residential and P1/Park & Recreation Districts, respectively. The properties comprise
the Kensington Green subdivision as well as 2 parcels adjacent to the Monon Greenway. Filed by the Department
of Community Services on behalf of the Carmel Plan Commission.
Project Overview:
Enclosed is a copy of the proposed ordinance and location maps. As indicated on the maps, the rezoning proposal
includes two areas. One area includes the undeveloped Kensington Green subdivision, and the other area includes two
parcels adjacent to the Monon Greenway. The city has been informed that the developer of the proposed Kensington
Green subdivision is no longer moving forward with the project; therefore, the zoning of those parcels is proposed to
match the surrounding UR/Urban Residential District. Due to the proximity of the other two parcels to the Monon
Greenway, the zoning is proposed to change to the P1/Park & Recreation District.
The standards of the UR/Urban Residential District are established in Article 2, Section 2.17 of the Carmel Unified
Development Ordinance. The standards of the P1/Park & Recreation District are established in Article 2, Section 2.01
of the Carmel Unified Development Ordinance. You may view the Unified Development Ordinance online by clicking on

Plan Commission Overview:
The Department presented both a location and existing zoning map which outlined the two areas of the proposal. The Plan
Commission asked for clarification of the locations and purpose of the proposed rezoning. Staff explai ned the boundaries
and reiterated the opportunity for the entire area to move forward under the Urban Residential District, which is now in
place north and east of Kensington Green. Staff also confirmed that any development proposals would be reviewed under
the standards of the UR District and improvements to Smokey Row corridor would be guided by the Thoroughfare Plan as
well as the Bicycle & Pedestrian Plan. One member of the public spoke with questions about the mailed public notice,
and it was confirmed to have been done properly. Another citizen indicated that he is generally in favor of the rezoning,
and a proposed development; however, he has concerns about a tax allocation proposal in the area, and he will take this up
with the Council. The Plan Commission ultimately forwarded the proposed rezoning to City Council with a favorable
recommendation.

The Carmel Plan Commission offers you the following report on the application (Docket
No. 19050029) petitioning to rezone 13 parcels from PUD and R1 to UR and P1,
respectively.
The Carmel Plan Commission's recommendation on the petition of the applicant is
Favorable."
At its regularly scheduled meeting of September 17, 2019, the Carmel Plan Commission
voted Eight (8) in Favor, Zero (0) Opposed, One (1) Absent, to forward to the Common
Council the proposed Ordinance No. Z-646-19 with a"Favorable Recommendation".
Please be advised that by virtue of the Plan Commission's Favorable Recommendation,
pursuant to IC 36-7-4-607(e), the Council has ninety (90) days to act on this petition
before it becomes effective as Certified by the Commission. Ninety days from the date of
the Certification is Tuesday, December 17, 2019.

Synopsis: 11
This ordinance rezones the former Kensington Green PUD to the UR/Urban Residential District and two 12
parcels adjacent to the Monon Greenway to the P1/Park & Recreation District. 13

WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted a unified 16
development ordinance, the terms of which are applicable to the geographic area consisting of the 17
incorporated area of the City of Carmel, Indiana, which unified development ordinance has been codified in 18
Chapter 10 of the Carmel City Code; and 19

WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the 21
map that is part of the unified development ordinance; and 22

WHEREAS, the Carmel Advisory Plan Commission gave a favorable recommendation on Tuesday, 24
September 17, 2019, to Docket No. 19050029 Z regarding the rezoning of 13 parcels located on the north 25
side of Smokey Row Road, between the Monon Greenway and Meridian Street, described and illustrated in 26
Exhibit A, which is incorporated herein by this reference (the “Real Property Parcels”). 27

NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, 29
that: 30
Section I: That the Official Zoning Map accompanying and made part of the Unified 31
Development Ordinance is hereby changed to designate the Real Property Parcels 32
from the PUD and R1/Residence Districts to the UR/Urban Residential and P1/Park & 33
Recreation Districts, respectively. 34
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance 35
are hereby repealed. 36
37 Section III: This Ordinance shall be in full force and effect from and after its passage and signing 38
by the Mayor. 39
